【摘要】：近年來,我國老齡化問題日益嚴重。為進一步應對人口老齡化所產生的社會壓力,居家養(yǎng)老服務作為一種創(chuàng)新社會治理方式在我國各省市和地區(qū)得以普及和推廣。居家養(yǎng)老服務既是對我國傳統(tǒng)家庭養(yǎng)老模式的完善和創(chuàng)新,也是我國構建社會主義特色的養(yǎng)老服務體系的重要內容。但就現(xiàn)階段而言,居家養(yǎng)老服務在實踐過程中仍然存在公共利益失衡、監(jiān)管責任缺失和缺乏法律規(guī)制等相關問題�；诖�,在行政法視野角度下,通過對于我國居家養(yǎng)老服務的發(fā)展現(xiàn)狀進行分析,并結合國外居家養(yǎng)老服務比較成熟的法治經驗,進一步剖析我國居家養(yǎng)老服務所面臨的法治問題,進而對我國居家養(yǎng)老服務法治保障問題的解決對策展開深入研究。
[Abstract]:In recent years, the aging problem in China is becoming more and more serious. In order to further cope with the social pressure caused by the aging of the population, the home pension service, as an innovative social governance method, has been popularized and popularized in various provinces and regions of China. Home old-age service is not only the perfection and innovation of the traditional family old-age care mode in China, but also the important content of constructing the socialistic characteristic pension service system in our country. However, at the present stage, there are still some related problems in the practice of home pension service, such as the imbalance of public interest, the lack of supervision responsibility and the lack of legal regulation. Based on this, from the perspective of administrative law, through the analysis of the current situation of the development of home pension services in China, and combined with the more mature experience of the rule of law of home pension services abroad, This paper further analyzes the problems of the rule of law faced by the family old-age service in our country, and further studies the countermeasures to solve the problem of the rule of law guarantee of the family old-age service in our country.
