中國(guó)特色社會(huì)主義民主政治進(jìn)程中的網(wǎng)絡(luò)政治監(jiān)督研究

【摘要】:伴隨著互聯(lián)網(wǎng)在中國(guó)的普及,輿論監(jiān)督和群眾監(jiān)督在互聯(lián)網(wǎng)這個(gè)新的載體上面相結(jié)合,構(gòu)建了監(jiān)督當(dāng)代中國(guó)政治的嶄新監(jiān)督形式——網(wǎng)絡(luò)政治監(jiān)督。網(wǎng)絡(luò)政治監(jiān)督是當(dāng)代中國(guó)民主政治的一大特色,它既是中國(guó)特色社會(huì)主義民主政治發(fā)展的產(chǎn)物,又是中國(guó)特色社會(huì)主義民主政治發(fā)展的重要內(nèi)容。 本文以互聯(lián)網(wǎng)時(shí)代的網(wǎng)絡(luò)政治監(jiān)督與我國(guó)民主政治的相互關(guān)系為主題展開研究,闡述了網(wǎng)絡(luò)政治監(jiān)督的基本內(nèi)涵、特點(diǎn)和本質(zhì);回顧了我國(guó)網(wǎng)絡(luò)政治監(jiān)督的發(fā)展歷程,指出網(wǎng)絡(luò)政治監(jiān)督是我國(guó)政治監(jiān)督的新形式,也是我國(guó)民主政治發(fā)展的新內(nèi)容。網(wǎng)絡(luò)政治監(jiān)督是我國(guó)民主政治發(fā)展的必然,從21世紀(jì)初到現(xiàn)在,我國(guó)網(wǎng)絡(luò)政治監(jiān)督發(fā)展大體經(jīng)過(guò)了三個(gè)階段,初步體現(xiàn)了網(wǎng)絡(luò)政治監(jiān)督的優(yōu)勢(shì),當(dāng)然也伴隨著網(wǎng)絡(luò)政治監(jiān)督的一些弊端。網(wǎng)絡(luò)政治監(jiān)督在推動(dòng)著我國(guó)民主政治建設(shè)的同時(shí),也對(duì)我國(guó)政治制度、意識(shí)形態(tài)和執(zhí)政黨的執(zhí)政能力提出了新的挑戰(zhàn)。應(yīng)對(duì)網(wǎng)絡(luò)政治監(jiān)督的挑戰(zhàn),必須要在思想意識(shí)形態(tài)、社會(huì)主義的本質(zhì)、共產(chǎn)黨的執(zhí)政能力等三個(gè)基本問(wèn)題上提高認(rèn)識(shí),把握好黨性原則、法治原則、寬容原則和引導(dǎo)原則,加強(qiáng)網(wǎng)絡(luò)立法、提高網(wǎng)民素質(zhì)、加強(qiáng)政府信息公開完善網(wǎng)絡(luò)政治監(jiān)督的體制機(jī)制等,推進(jìn)網(wǎng)絡(luò)政治監(jiān)督和中國(guó)特色社會(huì)主義民主政治建設(shè)的良性互動(dòng)。最后,要認(rèn)識(shí)到網(wǎng)絡(luò)政治監(jiān)督是現(xiàn)實(shí)政治監(jiān)督體系的有益補(bǔ)充,借助網(wǎng)絡(luò)監(jiān)督推動(dòng)民主政治是一個(gè)逐步探索和完善的過(guò)程。全文圍繞此思路,在理論和邏輯上展開,全文分為一個(gè)導(dǎo)論,五章正文,一個(gè)結(jié)束語(yǔ),共計(jì)七個(gè)部分。具體如下: 導(dǎo)論部分,介紹了本課題的研究緣由、研究意義,對(duì)國(guó)內(nèi)網(wǎng)相關(guān)研究做了綜述,從而為本課題的研究奠定了基礎(chǔ)。此部分還對(duì)本文的研究思路、研究方法和全文的邏輯結(jié)構(gòu)作了簡(jiǎn)要介紹。 第一章主要圍繞網(wǎng)絡(luò)政治監(jiān)督概念的基本內(nèi)涵、主要特征和網(wǎng)絡(luò)政治監(jiān)督實(shí)現(xiàn)的主要途徑進(jìn)行了分析。重點(diǎn)在于界定網(wǎng)絡(luò)政治監(jiān)督的內(nèi)涵,從而為全文的展開奠下基礎(chǔ)。本人認(rèn)為,所謂網(wǎng)絡(luò)政治監(jiān)督,是指網(wǎng)民以網(wǎng)絡(luò)為平臺(tái),在網(wǎng)絡(luò)世界里對(duì)現(xiàn)實(shí)生活中的政治現(xiàn)象、政治過(guò)程進(jìn)行評(píng)價(jià)、批評(píng)的一種行為。網(wǎng)絡(luò)政治監(jiān)督是兩類政治權(quán)力主體之間的權(quán)力監(jiān)督與制衡,網(wǎng)絡(luò)政治監(jiān)督的主體是擁有公民身份的網(wǎng)民,網(wǎng)絡(luò)政治監(jiān)督的客體以及監(jiān)督對(duì)象是政府及政府官員。網(wǎng)絡(luò)政治監(jiān)督的內(nèi)容是政府及其工作人員的政治活動(dòng)、政治事務(wù)、政治言論,對(duì)于經(jīng)濟(jì)、文化、社會(huì)等公共事務(wù)的監(jiān)督不在網(wǎng)絡(luò)政治監(jiān)督的范圍之內(nèi)。網(wǎng)絡(luò)政治監(jiān)督是對(duì)政治事務(wù)的非正式的政治參與,是憲法賦予我國(guó)公民的基本權(quán)利。它把現(xiàn)實(shí)政治生活中的群眾監(jiān)督和虛擬網(wǎng)絡(luò)環(huán)境下的網(wǎng)絡(luò)監(jiān)督結(jié)合起來(lái),是現(xiàn)代社會(huì)民主化發(fā)展進(jìn)程的必然。第一章還歸納了網(wǎng)絡(luò)政治監(jiān)督的主要特征,即監(jiān)督主體的大中性、監(jiān)督途徑的便捷性、監(jiān)督環(huán)境的純凈性、監(jiān)督成本的廉價(jià)性。實(shí)現(xiàn)網(wǎng)絡(luò)政治監(jiān)督的主要途徑有三方面,一是以網(wǎng)絡(luò)權(quán)力監(jiān)督政治權(quán)力,二是以網(wǎng)絡(luò)監(jiān)督制約政治權(quán)力,三是德性監(jiān)督政治權(quán)力。 第二章探討了我國(guó)網(wǎng)絡(luò)政治監(jiān)督發(fā)展的簡(jiǎn)要?dú)v程及其興起的原因。在回顧互聯(lián)網(wǎng)發(fā)展的基礎(chǔ)上,從網(wǎng)絡(luò)政治參與的視角,初步概括了我國(guó)網(wǎng)絡(luò)政治監(jiān)督發(fā)展的三個(gè)階段,即準(zhǔn)備階段、形成階段和發(fā)展階段,這三個(gè)階段,表現(xiàn)了網(wǎng)絡(luò)監(jiān)督從附議——表達(dá)——參與轉(zhuǎn)變的過(guò)程。我國(guó)網(wǎng)絡(luò)政治監(jiān)督興起和蓬勃發(fā)展的主要原因既是網(wǎng)絡(luò)技術(shù)發(fā)展提供的物質(zhì)條件,也是腐敗問(wèn)題和權(quán)力監(jiān)督失靈的現(xiàn)實(shí)需求,更是黨和政府對(duì)網(wǎng)絡(luò)政治監(jiān)督的主動(dòng)應(yīng)對(duì)。 第三章主要分析網(wǎng)絡(luò)政治監(jiān)督對(duì)中國(guó)特色社會(huì)主義民主政治建設(shè)的新機(jī)遇、新推動(dòng)。網(wǎng)絡(luò)政治監(jiān)是推動(dòng)社會(huì)主義民主政治建設(shè)的新手段,是擴(kuò)大公民政治參與的新平臺(tái),是強(qiáng)化政治權(quán)力監(jiān)督的新杠桿。網(wǎng)絡(luò)政治監(jiān)督為我國(guó)社會(huì)主義民主政治建設(shè)提供了新的機(jī)遇和推動(dòng)力。 第四章探討了網(wǎng)絡(luò)政治監(jiān)督對(duì)中國(guó)特色社會(huì)主義民主政治的挑戰(zhàn)。網(wǎng)絡(luò)政治監(jiān)督帶來(lái)新機(jī)遇的同時(shí),它也存在弊端,如網(wǎng)絡(luò)政治監(jiān)督主體的代表性存在質(zhì)疑、網(wǎng)絡(luò)政治監(jiān)督的可操作性和欺騙性、網(wǎng)絡(luò)政治監(jiān)督中出現(xiàn)的“網(wǎng)絡(luò)暴力”問(wèn)題以及網(wǎng)絡(luò)政治監(jiān)督的偶然性和隨意性。這些弊端,對(duì)我國(guó)社會(huì)主義民主政治制度構(gòu)成了挑戰(zhàn),造成合法性危機(jī);對(duì)我國(guó)政治制度的馬克思主義指導(dǎo)思想構(gòu)成了挑戰(zhàn),造成了信仰危機(jī);對(duì)我國(guó)民主政治的領(lǐng)導(dǎo)力量中國(guó)共產(chǎn)黨構(gòu)成了挑戰(zhàn),造成了信任危機(jī)。 第五章主要討論中國(guó)特色民主政治進(jìn)程中網(wǎng)絡(luò)政治監(jiān)督的治理和調(diào)試。建設(shè)社會(huì)主義民主政治,對(duì)網(wǎng)絡(luò)政治監(jiān)督的治理要注意把握黨性原則、法治原則、寬容原則和引導(dǎo)的原則。探討了民主政治進(jìn)程中正確應(yīng)對(duì)網(wǎng)絡(luò)政治監(jiān)督的策略:一是理性應(yīng)對(duì):提升網(wǎng)絡(luò)政治監(jiān)督的輿論引導(dǎo)能力;二是依法治網(wǎng):規(guī)范網(wǎng)絡(luò)政治監(jiān)督的根本保證;三是道德規(guī)范:網(wǎng)絡(luò)政治治理的基本要求;四是暢通渠道:提升網(wǎng)絡(luò)政治監(jiān)督的品質(zhì);五是制度完善:網(wǎng)絡(luò)政治監(jiān)督從網(wǎng)絡(luò)延伸到現(xiàn)實(shí)。 論文最后對(duì)網(wǎng)絡(luò)政治監(jiān)督與中國(guó)特色社會(huì)主義民主政治的未來(lái)進(jìn)行了展望。網(wǎng)絡(luò)監(jiān)督只是社會(huì)主義民主監(jiān)督諸多實(shí)踐形式中的-種,目前它與其他民主監(jiān)督一樣沒有實(shí)質(zhì)解決政治監(jiān)督得以順利展開的監(jiān)督權(quán)問(wèn)題,同時(shí)自身還有著難以克服的內(nèi)在缺陷,我們只能說(shuō),它為中國(guó)特色社會(huì)主義民主政治機(jī)制的創(chuàng)新提供了一種技術(shù)條件或突破口。網(wǎng)絡(luò)監(jiān)督的根本價(jià)值顯然是工具性的而不是目的性的,這意味著它絕非天然正當(dāng),其歷史地位與發(fā)展前景需要在民主政治實(shí)踐中展開具體分析。
