論法治背景下信訪制度的完善

【摘要】：近年來,我們經(jīng)常可以在各種媒體上看到這樣的畫面:人們帶著對(duì)現(xiàn)實(shí)的不滿和對(duì)上層權(quán)力的期盼,通過電話、書信和走訪,不怕險(xiǎn)難險(xiǎn)阻地一步步尋求來自高層權(quán)威者的渺茫而又有可能的關(guān)注和幫助�？梢�,當(dāng)人們的權(quán)益受到侵害時(shí),常常將獲取救濟(jì)的希望寄托在信訪之路上,信訪也已經(jīng)成為人們在生活中的一根重要的救命稻草,是一種很貼近人們生活的一種權(quán)利表達(dá)方式和糾紛解決途徑。信訪在現(xiàn)實(shí)中具有如此重要的地位,是我選擇關(guān)注信訪及信訪制度的首要原因。 在本文第一章,筆者對(duì)信訪制度進(jìn)行一般性考察,包括對(duì)信訪及信訪制度的概念、性質(zhì)、特征以及歷史回眸進(jìn)行闡述。信訪及信訪制度的內(nèi)涵是討論主題的邏輯起點(diǎn)。信訪概念有廣義和狹義之分,筆者傾向于狹義的信訪概念,認(rèn)為,信訪是指公民、法人和其它組織采用走訪或者書信、電子通信等形式,向各級(jí)人民政府以及縣級(jí)以上人民政府工作部門反映利益訴求,或者對(duì)國家機(jī)關(guān)及其工作人員提出意見、建議、批評(píng)或投訴,依法由相應(yīng)部門解決問題的活動(dòng)。同時(shí),根據(jù)對(duì)信訪定義的理解,認(rèn)為信訪制度是指由各級(jí)國家機(jī)關(guān)設(shè)置專門的信訪工作機(jī)構(gòu)并配備專職信訪工作人員,按照“分級(jí)負(fù)責(zé),便民辦理”的原則,處理人民群眾的來信、來訪、來電活動(dòng)的一項(xiàng)基本制度。信訪制度在我國存在的合理性分析是信訪制度的核心問題之一,這體現(xiàn)在本文第二章當(dāng)中。通過分析,首先,我們可以看到,信訪制度之所以在我國法治背景下存在,一方面取決于它本身具有的其他制度無法替代的優(yōu)勢,另一方面還取決于社會(huì)存在著各種深層原因。此外,信訪制度在實(shí)踐當(dāng)中還發(fā)揮著其他糾紛解決機(jī)制無法替代的功能。但是,任何制度的運(yùn)行都不可避免會(huì)遇到一定的困難。毫無例外,信訪制度在運(yùn)行中也陷入了一定的困境。要擺脫當(dāng)前所處的困境,就應(yīng)采取適當(dāng)措施完善信訪制度制度。為此,在第三章,筆者在借鑒國外類似信訪制度某些經(jīng)驗(yàn)后,對(duì)如何完善我國信訪制度提出了具體思考。 本文的創(chuàng)新之處在于,在第一章的信訪制度概述部分,在對(duì)信訪制度特征的概括上,從信訪制度自身特征和功能性特征兩大方面來歸類說明了信訪制度的特征,以便從理論和現(xiàn)實(shí)上更好的認(rèn)識(shí)我國的信訪制度的。在第二章,以哲學(xué)理論作為指導(dǎo),將內(nèi)因和外因相結(jié)合來進(jìn)行信訪制度在我國法治背景下存在的合理性分析。在第三章,我從多維角度來論述我國信訪制度的現(xiàn)狀和完善。特別是“將輿論監(jiān)督與信訪相結(jié)合”、“處理好信訪制度與行政復(fù)議、行政訴訟的銜接”是筆者結(jié)合我國民主監(jiān)督形式的發(fā)展以及幾種權(quán)利救濟(jì)途徑的特點(diǎn)而提出的一些個(gè)人見解。不足之處在于,在內(nèi)容方面,主要還是偏向借鑒學(xué)者先前的研究為主,以現(xiàn)有的理論探討為基礎(chǔ)來對(duì)信訪及信訪制度進(jìn)行整理,缺乏對(duì)信訪活動(dòng)進(jìn)行實(shí)地的調(diào)研,缺乏一定的案例和現(xiàn)實(shí)數(shù)據(jù)。
