【摘要】：在商品經(jīng)濟和市場經(jīng)濟活動中,商標扮演著重要的角色,它對于維護社會主義市場經(jīng)濟良性發(fā)展具有非常重要的意義。長期以來,我國商標法律制度發(fā)展并不如人意,隨著國際和國內(nèi)貿(mào)易迅速發(fā)展,尤其是我國加入世界貿(mào)易組織以來,經(jīng)濟社會環(huán)境發(fā)生了很大變化,現(xiàn)行《商標法》更是面臨許多新的挑戰(zhàn)和問題。 針對我國在商標法律及理論方面的某些不足和加強商標保護的必要性,本文在針對商標及商標保護立法的縱向歷史考察基礎(chǔ)上,比較借鑒國外商標保護立法的理論與實踐,結(jié)合發(fā)生在我國的一些商標案件,提出了完善我國商標法律制度的一些粗淺建議。希望通過以上的分析,以期有助于完善我國的商標法律制度。
[Abstract]:Trademark plays an important role in commodity economy and market economy, and it is of great significance to maintain the healthy development of socialist market economy. For a long time, the trademark legal system of our country has not developed as expected. With the rapid development of international and domestic trade, especially since China's entry into the World Trade Organization, the economic and social environment has undergone great changes. The current Trademark Law is facing many new challenges and problems. In view of some deficiencies in trademark law and theory in our country and the necessity of strengthening trademark protection, this paper compares the theory and practice of foreign trademark protection legislation on the basis of longitudinal historical investigation of trademark and trademark protection legislation. Combined with some trademark cases in China, some suggestions on how to perfect the trademark legal system in China are put forward. Hope through the above analysis, with a view to help improve our trademark legal system.
