【摘要】：作為懲治職務(wù)犯罪的機(jī)構(gòu),理想化的監(jiān)察機(jī)構(gòu)必須具有職權(quán)集中性、地位獨(dú)立性、管理垂直性、權(quán)力廣泛性等特點(diǎn)。然而,在我國(guó)部分地區(qū)試點(diǎn)中的監(jiān)察委員會(huì)卻與這個(gè)理想模式有較大距離:沒(méi)有將所有負(fù)有監(jiān)察職能的機(jī)構(gòu)合并進(jìn)來(lái);在管理體制上還存在著受地方制約以及難以保證監(jiān)察委員會(huì)在人財(cái)物方面的獨(dú)立性等不足。為此,必須在監(jiān)察體制上進(jìn)行大幅度的全新改造:將紀(jì)委以及審計(jì)機(jī)關(guān)中的監(jiān)察職權(quán)整合到監(jiān)察委員會(huì)之中;對(duì)監(jiān)察委員會(huì)實(shí)行完全獨(dú)立的垂直的領(lǐng)導(dǎo),使之完全擺脫對(duì)地方的依附;要賦予監(jiān)察委員會(huì)以更大的監(jiān)察職權(quán),尤其是對(duì)職務(wù)犯罪的調(diào)查職權(quán);與此同時(shí),要設(shè)計(jì)一套對(duì)監(jiān)察委員會(huì)進(jìn)行監(jiān)督的機(jī)制,并通過(guò)立法的方式使監(jiān)察委員會(huì)的構(gòu)建法治化。
[Abstract]:As an institution for punishing duty crimes, the idealized supervisory organization must have the characteristics of centralization of powers, independence of status, perpendicularity of management, extensiveness of power, etc. However, the supervisory committee in some regions of our country is far from this ideal model: it does not merge all the institutions with supervisory function; There are also deficiencies in the management system, such as local constraints and difficulties in ensuring the independence of the supervisory committee in terms of personal and property. To this end, it is necessary to carry out a radical new reform of the supervisory system: to integrate the supervisory powers of the discipline Inspection Commission and the audit institutions into the supervisory committee; and to exercise completely independent vertical leadership over the supervisory committee. It should be completely removed from its dependence on the local authorities; the supervisory committee should be given greater supervisory powers, especially with regard to the investigation of job-related crimes; at the same time, a mechanism for monitoring the supervisory committee should be devised. And through the way of legislation to make the construction of the supervisory committee rule of law.
