【摘要】：社會(huì)成員法治共識(shí)的缺乏,是當(dāng)代中國法治進(jìn)程中最值得關(guān)注的問題之一。社會(huì)成員在法治問題上的分歧,集中體現(xiàn)于理想主義法治觀與實(shí)用主義法治觀的差異。理想主義法治觀可分為樸素的理想主義、偏執(zhí)的理想主義和理性的理想主義三種類型;實(shí)用主義法治觀可分為樸素的實(shí)用主義、放縱的實(shí)用主義和理性的實(shí)用主義三種類型。理想主義法治觀與實(shí)用主義法治觀的形成及分歧,與法治知識(shí)傳播和交流中的智識(shí)屏障直接相關(guān),這些智識(shí)屏障造成了社會(huì)不同層面對(duì)法治本相了解的失真,進(jìn)而在一定程度上造就了法治觀念的差異。為此,應(yīng)通過法治的再啟蒙,強(qiáng)化全社會(huì)對(duì)于法治基本知識(shí)或法治本相的了解與認(rèn)同,并以此為基礎(chǔ),推動(dòng)全社會(huì)法治共識(shí)的形成。
[Abstract]:The lack of consensus on the rule of law among social members is one of the most noteworthy issues in the process of the rule of law in contemporary China. The formation and divergence of idealistic and pragmatistic views on the rule of law are directly related to the intellectual barriers in the dissemination and exchange of knowledge about the rule of law. These intellectual barriers have caused different social levels to confront each other. Therefore, through the re-enlightenment of the rule of law, we should strengthen the understanding and recognition of the basic knowledge of the rule of law or the essence of the rule of law in the whole society, and on this basis, promote the formation of the consensus of the rule of law in the whole society.
