【摘要】： 現(xiàn)代網(wǎng)絡(luò)技術(shù)的興起帶來了知識(shí)、信息的生產(chǎn)和傳播方式的巨大變革,其對(duì)社會(huì)政治生活的影響主要體現(xiàn)在網(wǎng)絡(luò)的民主功能上。為了對(duì)網(wǎng)絡(luò)的民主功能進(jìn)行深入的分析,我們先對(duì)傳統(tǒng)的公共領(lǐng)域理論進(jìn)行了概述,分析了公共領(lǐng)域的構(gòu)成要素,我們認(rèn)為,在網(wǎng)絡(luò)時(shí)代網(wǎng)絡(luò)公共領(lǐng)域業(yè)已形成,為網(wǎng)絡(luò)的民主功能的發(fā)揮提供了平臺(tái)。然后,我們又對(duì)民主的實(shí)現(xiàn)形式進(jìn)行了梳理,認(rèn)為協(xié)商民主理論基本上克服了傳統(tǒng)的直接民主制和代議制民主的弊端,是較為理想的民主實(shí)現(xiàn)形式,并且,目前的網(wǎng)絡(luò)公共領(lǐng)域已具有了實(shí)現(xiàn)協(xié)商民主理想的潛質(zhì)。然而,由于網(wǎng)絡(luò)的技術(shù)屬性、網(wǎng)絡(luò)群體的“群體極化”特性以及網(wǎng)絡(luò)輿論導(dǎo)致“民意失真”的可能,決定了網(wǎng)絡(luò)的民主功能又有其限度。最后,為了使網(wǎng)絡(luò)的民主功能能更好地得到發(fā)揮,我們?cè)噲D以公民知情權(quán)、言論自由和網(wǎng)絡(luò)政治參與為支撐進(jìn)行初步的制度建構(gòu)。
[Abstract]:The rise of modern network technology has brought great changes in the production and dissemination of knowledge and information, and its impact on social and political life is mainly reflected in the democratic function of the network. In order to deeply analyze the democratic function of the network, we first summarize the traditional theory of the public domain, and analyze the elements of the public domain. We think that in the network era, the public domain of the network has been formed. It provides a platform for the democratic function of the network. Then, we sort out the realization form of democracy. We think that the theory of consultative democracy basically overcomes the disadvantages of traditional direct democracy and representative democracy, and is an ideal form of democratic realization. At present, the network public domain has the potential to realize the democratic ideal of negotiation. However, because of the technical attribute of the network, the characteristics of "group polarization" of the network group and the possibility of "public opinion distortion" caused by the network public opinion, the democratic function of the network has its limits. Finally, in order to give full play to the democratic function of the network, we try to build a preliminary system supported by citizens' right to know, freedom of speech and network political participation.
