【摘要】：實現(xiàn)兩性平等參與公共政治生活是國家治理由"劣治"轉(zhuǎn)為"善治"的關(guān)鍵課題,為此,中國政府在憲法的基礎(chǔ)上通過自上而下的制度安排來給予女性更合理的政治位置。然而,系列規(guī)則集未能打破公共政治生活中不平等的性別結(jié)構(gòu),女性處于被邊緣化的政治地位,實質(zhì)是政治領(lǐng)域中性別利益剝奪后的一種政治貧窮化狀態(tài)。其原因在于政治制度規(guī)則集從文本內(nèi)容到實踐過程缺乏社會性別敏感,未能有效維護女性合法的政治權(quán)益,從而使該群體處于政治貧困狀態(tài)。對此,要進(jìn)行權(quán)利補救,在法治建設(shè)過程中實現(xiàn)政治參與制度規(guī)則的社會性別脫敏,從而維護與實現(xiàn)女性群體合法的政治權(quán)益。
[Abstract]:The realization of equal participation of both sexes in public political life is a key issue in national governance from "bad governance" to "good governance". Therefore, the Chinese government gives women a more reasonable political position through top-down institutional arrangements on the basis of the Constitution. However, the series of rules set has failed to break the unequal gender structure in public political life, and women are in marginalized political status, which is essentially a kind of political poverty after the deprivation of gender interests in the political field. The reason lies in the lack of gender sensitivity in the set of rules of political system from the content of the text to the process of practice, and the failure to effectively safeguard the legitimate political rights and interests of women, thus making the group in a state of political poverty. In order to protect and realize the legitimate political rights and interests of female groups, we should remedy the right and realize the gender desensitization of the rules of political participation system in the process of building the rule of law.
