【摘要】：宋慈總結(jié)長期刑獄工作心得,廣泛收集歷代有關(guān)司法檢驗(yàn)的精華整理編著的《洗冤集錄》,體現(xiàn)了宋慈"追求個(gè)案公正、防范刑罰濫用"的法理觀和"強(qiáng)調(diào)物證、優(yōu)化司法檢驗(yàn)技術(shù)"的證據(jù)觀。宋慈法治思想是宋代法制發(fā)展的縮影,是宋慈承繼前人研究基礎(chǔ)上的進(jìn)步和發(fā)展,其蘊(yùn)含的制度設(shè)計(jì)智慧對中國當(dāng)前法治建設(shè)具有積極的借鑒意義。
[Abstract]:Song Tzu summed up the long term prison work, and widely collected the collection and compilation of the essence of judicial inspection, which embodies the concept of "pursuit of case justice, the prevention of misuse of punishment", and the "emphasis on material evidence and the optimization of judicial inspection technology". Song Ci is the epitome of the development of the Song Dynasty and is the inheritance of song's inheritance. Based on the progress and development of previous studies, the wisdom of system design has a positive reference for China's current rule of law.
