【摘要】：二元制金融體系結(jié)構(gòu)下,農(nóng)村正規(guī)金融與民間金融的相互博弈關(guān)系體現(xiàn)為分割、競(jìng)爭(zhēng)、互補(bǔ)和聯(lián)結(jié)四種類(lèi)型。盡管后者在信息甄別、監(jiān)督和合約執(zhí)行上具有獨(dú)特的優(yōu)勢(shì),但其逐利性也被日趨放大,而與之配套的農(nóng)村金融法律供給又存在異化:一是相關(guān)法律供給與需求不均衡;二是正式金融機(jī)制、法律制度與農(nóng)村社會(huì)內(nèi)生規(guī)則存在天然的沖突性,因而極易產(chǎn)生隱藏行為,隱藏信息和道德風(fēng)險(xiǎn)。應(yīng)以社會(huì)公平和市場(chǎng)效率作為法律治理之理念邏輯;著眼于完善相關(guān)金融法律法規(guī),凸顯非正式制度的輔助效用;建立金融風(fēng)險(xiǎn)防范機(jī)制,全面提升金融監(jiān)管力度與執(zhí)法水平;應(yīng)強(qiáng)調(diào)聲譽(yù)機(jī)制的效應(yīng)性,立足建立健全的農(nóng)村民間金融安全信用制度,建構(gòu)法律監(jiān)管與聲譽(yù)約束的相互協(xié)調(diào)機(jī)制。
[Abstract]:Under the dualistic financial system structure, the relationship between rural formal finance and private finance is embodied in four types: division, competition, complementarity and connection. Although the latter has unique advantages in information screening, supervision and contract execution, its profit-driven nature is also enlarged day by day, and the corresponding rural financial legal supply is dissimilated: first, the relevant legal supply and demand are not balanced; Second, the formal financial mechanism, the legal system and the rural society endogenous rules have the nature of conflict, so it is easy to produce hidden behavior, hidden information and moral hazard. We should take social equity and market efficiency as the ideal logic of legal governance, focus on perfecting the relevant financial laws and regulations, highlight the auxiliary effect of informal system, establish financial risk prevention mechanism, and improve the financial supervision and law enforcement level in an all-round way. We should emphasize the effect of reputation mechanism, establish a sound rural folk financial safety credit system, and construct a mutual coordination mechanism between legal supervision and reputation constraint.
