【摘要】：近年來,隨著我國依法治國方略的不斷落實(shí)以及法治化進(jìn)程的不斷加快,公民權(quán)利與法制意識明顯增強(qiáng),越來越多的公民懂得通過法律手段來維護(hù)自身的合法權(quán)益,大學(xué)生思想政治教育管理也同樣面臨著一場適應(yīng)國家法治化進(jìn)程的深刻變革。依法治校,就是高校管理者以實(shí)現(xiàn)學(xué)校管理與運(yùn)行機(jī)制的制度化、規(guī)范化為目標(biāo),依照法律對學(xué)校各項(xiàng)事務(wù)進(jìn)行管理,逐步實(shí)現(xiàn)政府宏觀管理,學(xué)校依法’按照章程自主辦學(xué),依法接受監(jiān)督的格局。依法治校本質(zhì)上就是正確處理高校師生之間法律關(guān)系的動態(tài)過程,因此可以說,學(xué)生管理工作尤其是思想政治教育管理和程序流程的法治化是依法治校的重要支點(diǎn)。將大學(xué)生思想政治教育管理工作納入法治化的軌道也成為了時代發(fā)展的必然。大學(xué)生思想政治教育管理工作的好壞是影響高校辦學(xué)質(zhì)量、制約高等教育發(fā)展最為重要的因素之一。大學(xué)生思想政治教育管理法治化建設(shè)是社會主義市場經(jīng)濟(jì)的客觀要求,是培養(yǎng)社會主義合格建設(shè)者和可靠接班人重要保障,是用法律的手段保障社會主義辦學(xué)方向的需要,也是大學(xué)生思想政治教育管理自身創(chuàng)新發(fā)展的需要。 近年來伴隨著依法治校的進(jìn)程,高校涉訴案件的數(shù)量和復(fù)雜程度日益提高,既有的大學(xué)生思想政治教育管理暴露出立法水平不高,現(xiàn)行法律規(guī)定過于原則,缺乏可操作性的因素；也有大學(xué)生思想政治教育管理行為不注重程序規(guī)范,未能做到資源的優(yōu)化配置,在處理違紀(jì)學(xué)生時,未能做到全過程法治化等方面的原因。大學(xué)生思想政治教育管理理念、程序、權(quán)威以及大學(xué)生思想政治教育管理者的法律水平等都面臨著前所未有的挑戰(zhàn),高校必須采取相關(guān)對策,學(xué)會用“法治”的理念來解決實(shí)踐中出現(xiàn)的情況和問題,“法治化”便成為了大學(xué)生思想政治教育管理工作的必由之路。 大學(xué)生思想政治教育管理法治化是一項(xiàng)系統(tǒng)工程。通過加強(qiáng)高校思想政治法制建設(shè),注重對高校校內(nèi)規(guī)定的審查,確保下位法不違背上位法的原則和精神,確保“良法之治”；以完善學(xué)生權(quán)利救濟(jì)制度為契機(jī),在大學(xué)生思想整治教育和管理中更加注重程序規(guī)范,適當(dāng)借鑒聽證、仲裁等制度。通過積極營造依法治校良好環(huán)境,切實(shí)樹立大學(xué)生思想整治教育和管理法治、平等和服務(wù)的理念,進(jìn)一步完善大學(xué)生思想整治教育管理的運(yùn)作模式,扎實(shí)推進(jìn)大學(xué)生思想政治教育管理法治化建設(shè)。當(dāng)然在實(shí)施大學(xué)生思想整治教育和管理法治化的過程中,也要注意避免用法治來代替大學(xué)生思想整治教育的誤區(qū),大學(xué)生思想政治教育管理法治化進(jìn)程中思想政治教育立法和執(zhí)法都要堅持適度性原則,注意避免思想政治教育過程中的全面法律化。 依法治校是現(xiàn)代學(xué)校管理的理性追求,大學(xué)生思想政治教育管理法治化是建立現(xiàn)代大學(xué)制度重要內(nèi)容,是高等教育科學(xué)發(fā)展的重要保障。
[Abstract]:In recent years, with the implementation of the strategy of governing the country according to law and the speeding up of the process of ruling by law, the awareness of civil rights and the legal system has obviously increased. More and more citizens know how to safeguard their legitimate rights and interests through legal means. The management of college students' ideological and political education is also facing a profound change adapting to the process of national rule of law. Running a school according to law means that the university administrator aims at institutionalizing and standardizing the management and operation mechanism of the school, manages the affairs of the school according to the law, gradually realizes the macroscopic management of the government, and the school runs a school independently in accordance with the regulations. The pattern of accepting supervision according to law. Running a school according to law is essentially a dynamic process of correctly handling the legal relationship between teachers and students in colleges and universities. Therefore, it can be said that the management of students, especially the management of ideological and political education and the rule of law in the process of procedure, is the important fulcrum of administering the school according to law. It is inevitable for the development of the times to bring the ideological and political education management of college students into the track of ruling by law. The quality of college students' ideological and political education management is one of the most important factors that influence the quality of higher education and restrict the development of higher education. The legal construction of college students' ideological and political education management is an objective requirement of socialist market economy, an important guarantee to train qualified socialist builders and reliable successors, and a need to ensure the direction of socialist schools by means of law. Also is the university student ideological and political education management own innovation development needs. In recent years, with the process of running schools according to law, the number and complexity of litigation cases in colleges and universities are increasing day by day. The existing college students' ideological and political education management has revealed that the legislative level is not high, and the current legal provisions are too principled. There are also some reasons that college students' ideological and political education management behavior does not pay attention to the procedure standard, fails to optimize the allocation of resources, and fails to achieve the rule of law in the whole process when dealing with students in violation of discipline. The management concept, procedure, authority and the legal level of college students' ideological and political education management are facing unprecedented challenges. Colleges and universities must take relevant countermeasures. Learning to use the concept of "rule of law" to solve the situation and problems in practice, "rule by law" has become the only way to the ideological and political education management of college students. The legalization of ideological and political education management of college students is a systematic project. Through strengthening the construction of ideological and political legal system in colleges and universities, paying attention to the examination of the regulations in colleges and universities, ensuring that the inferior law does not violate the principle and spirit of the superior law, ensuring "good law governance", taking the perfect relief system of students' rights as an opportunity, In the education and management of college students' ideological improvement, we should pay more attention to the procedure standard, draw lessons from the system of hearing, arbitration and so on. By actively creating a good environment for running a university according to law, setting up the ideas of ideological renovation, education, management, rule of law, equality and service for college students, and further perfecting the operation mode of the educational management of ideological renovation for college students, We will firmly promote the legalization of the administration of ideological and political education among college students. Of course, in the process of carrying out the ideological rectification education and the legalization of management of college students, we should also pay attention to avoiding the mistake of using the rule of law as a substitute for the ideological rectification education of college students. In the course of the management of college students' ideological and political education by law, the legislation and law enforcement of ideological and political education should adhere to the principle of moderation and pay attention to avoiding the comprehensive legalization in the process of ideological and political education. Running a university by law is the rational pursuit of modern school management. The legalization of ideological and political education management for college students is an important content of establishing modern university system and an important guarantee for the scientific development of higher education.
