【摘要】：法治與德治相結(jié)合是中國特色社會主義法治道路的鮮明特征。就現(xiàn)代國家治理而言,二者相輔相成有著自身的客觀基礎(chǔ)和內(nèi)在邏輯。這些內(nèi)在邏輯包括:良法的理論邏輯即法律是成文的道德;良序的理論邏輯即道德踐行離不開法律約束;普遍守法的實踐邏輯即以道德滋養(yǎng)法治;法律至上的實踐邏輯即關(guān)鍵少數(shù)帶頭崇德守法。
[Abstract]:The combination of rule by law and rule by virtue is a distinctive feature of the road of socialist rule of law with Chinese characteristics. As far as modern state governance is concerned, they complement each other with their own objective basis and internal logic. These internal logic include: the theoretical logic of the good law, that is, the law is the written morality; the theoretical logic of the good order, that is, the moral practice cannot be separated from the legal constraints; the universal practice logic of abiding by the law, that is, nourishing the rule of law by morality; The practical logic of the supremacy of law is the key minority to take the lead in upholding the law.
