【摘要】：黨內(nèi)法規(guī)是調(diào)整黨內(nèi)行為關系的規(guī)范,由黨內(nèi)專門機關制定、認可和解釋,以權利和義務的雙向規(guī)定為調(diào)整機制,通過程序予以強制實施。本文從橫向和縱向上對黨內(nèi)法規(guī)進行了劃分,呈現(xiàn)出一個分工科學嚴密,層次清晰明確的黨內(nèi)法規(guī)體系。黨內(nèi)法規(guī)是規(guī)范黨內(nèi)主體行為和黨內(nèi)關系的前提,是發(fā)展和鞏固黨內(nèi)民主的保障,黨內(nèi)法規(guī)是建立反腐倡廉制度的重要組成部分。黨內(nèi)法規(guī)也是中國共產(chǎn)黨在中國社會革命、建設和改革開放過程中的一個重要的組成部分。在中國共產(chǎn)黨90多年的歷程中,黨內(nèi)法規(guī)在不同的歷史時期以不同的形式反映著不同的歷史內(nèi)容,體現(xiàn)著不同的歷史特征。本文主要研究了黨內(nèi)法規(guī)在三個階段的特征:新民主主義時期,社會主義革命和建設時期,改革開放和社會主義現(xiàn)代化建設時期。研究中國共產(chǎn)黨黨內(nèi)法規(guī)制度建設時,應秉持一種開放的眼光,各國政黨在性質(zhì)、信仰、綱領、執(zhí)政理念和社會基礎等方面千差萬別,但在加強自身法規(guī)制度建設方面仍存在一些帶有共性的東西。本文以新加坡的人民行動黨和德國的社會民主黨的黨內(nèi)法規(guī)為例進行研究,并闡述了兩國黨內(nèi)法規(guī)建設對我國的借鑒與啟發(fā)的思考。黨內(nèi)法規(guī)與國家法律是兩個不同的概念,兩者既有聯(lián)系又有區(qū)別,相輔相成,各自在推進黨的建設和依法治國中發(fā)揮了重要作用。受諸多主客觀條件的限制,黨內(nèi)法規(guī)與國家法律之間還存在一些不協(xié)調(diào)的地方,有時甚至會發(fā)生沖突。處理好黨內(nèi)法規(guī)與國家法律之間的關系要求我們努力構建一種雙向的溝通協(xié)調(diào)機制。黨內(nèi)法規(guī)在實施過程中,存在著政黨法治的環(huán)境缺失和理念淡薄,處理政黨關系、規(guī)范政黨行為的法律和制度不到位,國家法律和黨規(guī)黨紀執(zhí)行力不足的問題。本文就解決這些問題提出了五個方面的建議:培育法治信仰,為政黨法治提供政治文化生態(tài);健全政黨法制,為政黨法治提供本體依托;科學合理配置政黨權力,為政黨法治提供體制條件;完善權力監(jiān)督,為政黨法治提供政治基礎;提高依法治黨管黨的執(zhí)行力。
[Abstract]:The inner-party laws and regulations are the norms to adjust the inner-party behavior relations, which are formulated, approved and interpreted by the specialized organs within the Party, and enforced through the procedure with the bi-directional provisions of rights and obligations as the adjustment mechanism. This paper divides the inner-party laws and regulations horizontally and longitudinally, and presents a scientific and strict division of labor and a clear and clear system of inner-party laws and regulations. The inner-party laws and regulations are the premise of standardizing the inner-party main body behavior and the inner-party relations, and the guarantee of the development and consolidation of inner-party democracy. The inner-party laws and regulations are an important part of the establishment of the anti-corruption system. Party laws and regulations are also an important part of the Communist Party of China in the process of social revolution, construction and reform and opening up. In the course of more than 90 years of Communist Party of China, inner-party laws and regulations reflect different historical contents and different historical characteristics in different historical periods. This paper mainly studies the characteristics of inner-party laws and regulations in three stages: the period of new democracy, the period of socialist revolution and construction, the period of reform and opening up and the period of socialist modernization construction. When studying the construction of the laws and regulations of the Communist Party of China, we should keep an open mind. Political parties in various countries vary widely in nature, belief, program, governing concept and social foundation, etc. However, there are still some things in common in strengthening the construction of their own laws and regulations. This paper takes the laws and regulations of the people's Action Party of Singapore and the Social Democratic Party of Germany as an example, and expounds the reference and inspiration of the construction of the laws and regulations of the two countries to our country. The inner-party law and the national law are two different concepts, which are related and different, complement each other, and play an important role in promoting the party building and governing the country according to law. Limited by many subjective and objective conditions, there are still some inharmonies between inner-party laws and national laws, sometimes even conflicts. Dealing well with the relationship between party laws and national laws requires us to build a two-way communication and coordination mechanism. In the process of implementing the laws and regulations within the Party, there are some problems such as lack of environment and weak idea of ruling by law of political parties, dealing with the relations of political parties, inadequate laws and systems of standardizing the behavior of political parties, and insufficient enforcement of national laws and party rules and regulations. This paper puts forward five suggestions to solve these problems: cultivating the belief of ruling by law, providing political and cultural ecology for the rule of law of political parties, perfecting the legal system of political parties, providing the Noumenon support for the rule of law of political parties, distributing the power of political parties scientifically and rationally. To provide the institutional conditions for the rule of law of political parties, to perfect the supervision of power, to provide the political basis for the rule of law of political parties, and to improve the executive power of administering the party according to law.
