【摘要】：鄧小平法治思想是馬克思列寧主義的法學(xué)基本原理同當(dāng)代中國實(shí)踐和時代特征相結(jié)合的產(chǎn)物,是毛澤東法學(xué)思想在新的歷史條件下的繼承和發(fā)展,是馬克思主義法治思想在中國發(fā)展的新階段,是當(dāng)代中國的馬克思主義法治思想,是中國共產(chǎn)黨集體智慧的結(jié)晶,引導(dǎo)著我國建設(shè)社會主義法治國家事業(yè)不斷前進(jìn)。鄧小平法治思想開啟了我國法治建設(shè)的新篇章,并在實(shí)踐中奠定了我國社會主義法治建設(shè)的基礎(chǔ),明確了依法治國建設(shè)的方向,為我國以后的法治國家建設(shè)規(guī)劃了藍(lán)圖。 通過對鄧小平法治思想、江澤民依法治國建設(shè)社會主義法治國家治國方略及胡錦濤科學(xué)發(fā)展觀與和諧社會理念下的一系列法治思想的深入研究和分析,明確了鄧小平法治思想對建設(shè)我國社會主義法治國家的重要意義。改革開放三十多年來,我國社會主義法治國家的建立與發(fā)展,正是在鄧小平法治思想的指導(dǎo)下進(jìn)行的。研究鄧小平法治思想及其新發(fā)展,對于認(rèn)清我國新時期法治發(fā)展規(guī)律,明確社會主義法治建設(shè)方向,建設(shè)中國特色的社會主義法治國家,具有重要的理論和實(shí)踐意義。鄧小平、江澤民、胡錦濤的法治思想在建設(shè)社會主義法治國家的道路上,無論是過去還是現(xiàn)在都是我國法治建設(shè)的指導(dǎo)思想和行動指南,在實(shí)踐中我們必須以它們?yōu)橹笇?dǎo),并堅決予以貫徹執(zhí)行,才能保證我們在社會主義法治國家的道路上不迷失方向,堅定地沿著社會主義的方向前進(jìn)。中華民族偉大復(fù)興事業(yè),才能獲得穩(wěn)定的建設(shè)環(huán)境,同時也希望本文能為中國新時期建設(shè)社會主義法治國家提供一些理論參考。 本文分四個部分論述:第一章概述法治的一般理論為研究鄧小平法治思想打下理論基礎(chǔ)。第二章概述鄧小平法治思想形成的歷史背景,理論基礎(chǔ),為全面理解鄧小平法治思想做好理論準(zhǔn)備。第三章主要論述鄧小平法治思想的基本內(nèi)容以及歷史地位。鄧小平法治思想的基本內(nèi)容非常豐富,用鄧小平的原話可以概括為八個方面:發(fā)展社會主義民主,健全社會主義法制;我們的法律太少了;法律面前人人平等;一手抓建設(shè),一手抓法制;法律范圍的問題,要用法制來解決;警察不夠,警官更不夠,法院院長、法官、律師、檢察官、審判員都缺乏;有法可依,有法必依,執(zhí)法必嚴(yán),違法必究;法律制度教育要從娃娃抓起。第四章論述鄧小平法治思想的新發(fā)展,主要內(nèi)容有:鄧小平法治思想與江澤民法治思想、科學(xué)發(fā)展觀、和諧社會、社會主義法治理念的之間的聯(lián)系,以及后者對其的繼承與發(fā)展。
[Abstract]:Deng Xiaoping's legal thought is the product of the combination of the basic principles of Marxism-Leninist jurisprudence with the contemporary Chinese practice and the characteristics of the times. It is also the inheritance and development of Mao Zedong's legal thought under the new historical conditions. It is the new stage of the development of Marxist thought of rule of law in China, the thought of Marxist rule of law in contemporary China, the crystallization of the collective wisdom of the Communist Party of China, and the continuous progress of the cause of building a socialist country ruled by law in our country. The thought of Deng Xiaoping rule of law has opened a new chapter in the construction of the rule of law in our country, and in practice has laid the foundation of the construction of the socialist rule of law in our country, defined the direction of the construction of governing the country by law, and planned the blueprint for the construction of the country ruled by law in the future. Through the deep research and analysis of Deng Xiaoping's thought of ruling by law, Jiang Zemin's strategy of governing the country by law and the idea of Hu Jintao's scientific development and harmonious society. This paper clarifies the significance of Deng Xiaoping's thought of rule of law to the construction of socialist country ruled by law in our country. Since the reform and opening to the outside world, the establishment and development of China's socialist country ruled by law has been carried out under the guidance of Deng Xiaoping's thought of rule of law. It is of great theoretical and practical significance to study the thought of Deng Xiaoping rule by law and its new development, to recognize the law of rule of law in the new period of our country, to make clear the direction of the construction of socialist rule of law, and to build a socialist country ruled by law with Chinese characteristics. The rule of law thought of Deng Xiaoping, Jiang Zemin, Hu Jintao is the guiding ideology and action guide of our country's legal construction in the past and present, and we must take them as the guide in practice. Only by implementing it resolutely can we ensure that we do not lose our way on the road of a socialist country ruled by law and advance firmly along the socialist direction. Only the great rejuvenation of the Chinese nation can obtain a stable construction environment, and at the same time, I hope this paper can provide some theoretical references for the construction of a socialist country ruled by law in the new period of China. This paper is divided into four parts: the first chapter summarizes the general theory of rule of law for the study of Deng Xiaoping rule of law theory laid a theoretical foundation. The second chapter summarizes the historical background and theoretical basis of the formation of Deng Xiaoping's thought of rule of law, and makes theoretical preparations for an all-round understanding of Deng Xiaoping's thought of rule of law. The third chapter mainly discusses the basic content and historical position of Deng Xiaoping's thought of rule of law. The basic content of Deng Xiaoping's thought of rule of law is very rich, which can be summed up in the original words of Deng Xiaoping: developing socialist democracy and perfecting socialist legal system; our laws are too few; everyone is equal before the law; It is necessary to solve the problems within the scope of the law by the legal system; if the police are not enough, the police officers are not enough, the presidents of the courts, judges, lawyers, prosecutors and judges are lacking; there are laws to be observed, the laws must be strictly enforced and the violations of the law must be investigated; Education in the legal system should begin with a doll. The fourth chapter discusses the new development of Deng Xiaoping's rule of law thought. The main contents are: the relation between Deng Xiaoping's rule of law thought and Jiang Zemin's rule of law thought, scientific development view, harmonious society, socialist rule by law idea. And the latter's inheritance and development.
