【摘要】：法制現(xiàn)代化既包括法律制度的現(xiàn)代化,也包括法律觀念的現(xiàn)代化,就實現(xiàn)依法治國,建設法治國家的宏偉目標而言,公民法律意識的進步、法治觀念的確立,是至關重要的先決條件。然而,先進的制度和法律可以通過引進或移植的方式獲得,而法律觀念是民族文化、民族傳統(tǒng)的歷史積淀,內含有鮮明的價值判斷和精神取向,具有強烈的民族性、傳統(tǒng)性、穩(wěn)定性和保守性,其發(fā)展、變化的進程是緩慢而艱苦的。因此,新型法律文化觀念無法像法律制度一樣通過引進或移植迅速生長。本文對法治現(xiàn)代化進程中法律文化觀念的沖突的探討,得出符合法制現(xiàn)代化的法律文化觀念的融合的必要性和融合的路徑 本文首先從法制現(xiàn)代化和法律文化觀念的內涵入手,探討法制現(xiàn)代化與法律文化觀念的關系,透過國內外學者對法律文化的不同理解來逐步探討法律文化觀念的內涵,并通過對當代中國法律文化觀念現(xiàn)狀中中西法律文化觀念的沖突表現(xiàn)、傳統(tǒng)與現(xiàn)代法律文化觀念沖突表現(xiàn)進行分析,研究當代法律文化觀念融合的可能性和必要性,以及對多元法律文化觀念融合的基礎的闡述。 本文分別運用了語義分析法、歷史比較法等對法律文化本身以及中國當代法律文化觀念的沖突與融合進行闡述和分析。通過法律文化生成的社會經(jīng)濟基礎,政治基礎和文化基礎等方面來研究中國當代法律文化觀念融合的基礎,以及法律文化觀念融合的路徑。 在中國,要建設法治國家,我們不僅要關注法律制度建設,更為重要的是要關注思想文化層面的法律文化建設;不僅要移植西方的法律制度,在更大程度上也要注重對中國的優(yōu)秀傳統(tǒng)法律文化的繼承、發(fā)展與改造。中國人民在中國共產(chǎn)黨的領導下,正在努力建設法治國家,這個法治國家和社會主義市場經(jīng)濟、民主政治、精神文明緊密聯(lián)系在一起;在建設社會主義法治國家中,我們不僅要借鑒西方國家優(yōu)秀的法治經(jīng)驗,而且還要走有中國特色的社會主義法治國家之路。中國傳統(tǒng)法律文化與現(xiàn)代法治觀念之間存在沖突、中西方法律文化觀念的沖突,我們應該正視它們,并且進行協(xié)調,形成當代中國的法治觀念。
[Abstract]:The modernization of the legal system includes the modernization of the legal system as well as the modernization of the legal concept. In terms of realizing the grand goal of governing the country according to law and building a country ruled by law, the citizens' legal consciousness and the establishment of the concept of the rule of law are advanced. Is a vital prerequisite. However, advanced systems and laws can be obtained by way of introduction or transplantation, and the concept of law is the historical accumulation of national culture and national tradition, which contains distinct value judgment and spiritual orientation, and has a strong national character and tradition. Stability and conservatism, its development, the process of change is slow and arduous. Therefore, the new concept of legal culture can not grow as quickly as the legal system through the introduction or transplantation. This paper probes into the conflict of legal cultural concepts in the process of modernization of the rule of law. This paper discusses the relationship between legal modernization and legal cultural concept, starting with the connotation of legal modernization and legal cultural concept, and finds out the necessity and path of the fusion of legal cultural concepts in accordance with the modernization of the legal system, this paper discusses the relationship between the modernization of the legal system and the concept of legal culture. Through the different understanding of legal culture by scholars at home and abroad, the connotation of legal cultural concept is gradually discussed, and the conflict between Chinese and western legal cultural concepts is reflected through the present situation of legal cultural concept in contemporary China. This paper analyzes the conflict between traditional and modern legal cultural concepts, studies the possibility and necessity of the fusion of contemporary legal cultural concepts, and expounds the basis of the fusion of pluralistic legal cultural concepts. This paper uses the semantic analysis method and the historical comparative method to explain and analyze the conflict and fusion of the legal culture itself and the contemporary Chinese legal culture concept. Through the social and economic basis, political basis and cultural basis of legal culture, this paper studies the basis of the fusion of contemporary legal cultural concepts in China and the path of the fusion of legal cultural concepts. In China, in order to build a country ruled by law, we should not only pay attention to the construction of legal system, but also, more importantly, to the construction of legal culture at the ideological and cultural level, not only to transplant the western legal system, To a greater extent, emphasis should also be placed on the inheritance, development and transformation of China's excellent traditional legal culture. Under the leadership of the Communist Party of China, the Chinese people are working hard to build a country ruled by law, which is closely linked to socialist market economy, democratic politics, and spiritual civilization. We should not only learn from the outstanding experience of western countries, but also follow the road of socialist country ruled by law with Chinese characteristics. There is a conflict between the traditional Chinese legal culture and the modern concept of the rule of law, so we should face them squarely and coordinate to form the concept of the rule of law in contemporary China.
