治理視角下的公民社會(huì)構(gòu)建

【摘要】:改革開放30年以來,政治秩序經(jīng)歷了從特權(quán)、不平等、封閉的政治向普遍、平等和開放的政治逐步轉(zhuǎn)型,對推進(jìn)政府治理藝術(shù)的變革提出了更高的要求,單是依靠國家自身的力量已經(jīng)不能滿足社會(huì)發(fā)展的需求。所以為了增強(qiáng)政府的合法性、改善政府的治理模式,最終實(shí)現(xiàn)公共利益最大化的目標(biāo),構(gòu)建一個(gè)能夠容納多元社會(huì)權(quán)力主體的善治治理模式就顯得十分迫切。公民社會(huì)組織在正確處理國家與社會(huì)的關(guān)系、促進(jìn)社會(huì)合作治理中的有效參與、建立國家權(quán)威的合法性以及促進(jìn)社會(huì)的協(xié)同治理等各方面都發(fā)揮了相應(yīng)的作用。為了適應(yīng)社會(huì)的發(fā)展,就需要構(gòu)建公民社會(huì),促進(jìn)政府治理理念的轉(zhuǎn)變,最終實(shí)現(xiàn)政府的善治目標(biāo)。構(gòu)建一個(gè)健康的公民社會(huì),則必須推進(jìn)政府治理范式的變革,建立一個(gè)政府與公民間進(jìn)行有效對話機(jī)制的、法治、高效、透明、問責(zé)的制度環(huán)境。 本文第一部分對公民社會(huì)構(gòu)建是政府實(shí)現(xiàn)善治的社會(huì)基礎(chǔ)做了闡釋。善治與公民社會(huì)在法治性、服務(wù)性、民主性和協(xié)同性有著契合之處,在實(shí)現(xiàn)政府善治的進(jìn)程中公民社會(huì)能夠促進(jìn)我國政府合法性的提升、促進(jìn)民主政治的建設(shè)、促使我國政府由“官本位”轉(zhuǎn)向“民本位”、協(xié)助政府為公民更好的提供公共物品。第二部分,分析了公民社會(huì)與政府間關(guān)系的演變路徑、應(yīng)然關(guān)系以及公民社會(huì)參與公共事務(wù)治理的現(xiàn)實(shí)路徑。我國公民社會(huì)與政府間的關(guān)系由最早的政府控制公民社會(huì)演變?yōu)檎c公民社會(huì)的獨(dú)立、平等、互信、協(xié)作的關(guān)系。目前公民社會(huì)主要通過參與政策制定、提供公共產(chǎn)品、協(xié)調(diào)利益關(guān)系等途徑參與公共事務(wù)的協(xié)同治理。第三部分,概述了公民社會(huì)構(gòu)建的現(xiàn)實(shí)困境以及政府責(zé)任缺失的實(shí)然狀況。公民社會(huì)構(gòu)建過程中其非政府性很難保證、運(yùn)轉(zhuǎn)的自治性不充分、管理監(jiān)督不規(guī)范且組織的多元性還很不充足。政府在公民社會(huì)構(gòu)建中未能給公民社會(huì)的發(fā)展提供有利的文化、制度、法律環(huán)境以及均衡的資金支撐。第四部分,闡釋了政府在公民社會(huì)構(gòu)建中應(yīng)承擔(dān)的責(zé)任有:構(gòu)建現(xiàn)代政治文化,為公民社會(huì)提供有利文化環(huán)境;完善民主法制建設(shè),為公民社會(huì)提供有利制度環(huán)境;推進(jìn)政府善治進(jìn)程,為公民社會(huì)提供有利行政環(huán)境;均衡資金支持力度,為公民社會(huì)提供有力資源支撐。
[Abstract]:Since the reform and opening up 30 years ago, the political order has experienced a gradual transformation from privilege, inequality, closed politics to universal, equal and open politics, which puts forward higher requirements for the reform of the art of government governance. Relying solely on the strength of the country itself has not been able to meet the needs of social development. Therefore, in order to enhance the legitimacy of the government, improve the governance model of the government, and finally achieve the goal of maximizing public interest, it is urgent to build a good governance model that can accommodate multiple social power subjects. Civil society organizations have played a corresponding role in dealing with the relationship between the state and society, promoting the effective participation in the social cooperative governance, establishing the legitimacy of the state authority, and promoting the cooperative governance of the society. In order to adapt to the development of society, it is necessary to construct a civil society, promote the transformation of the concept of government governance, and finally realize the goal of good governance of the government. To build a healthy civil society, we must push forward the transformation of government governance paradigm, establish an effective dialogue mechanism between government and citizens, rule by law, efficient, transparent and accountable institutional environment. The first part of this paper explains that the construction of civil society is the social foundation for the government to achieve good governance. Good governance is in agreement with civil society in the rule of law, service, democracy and coordination. In the process of realizing good governance, civil society can promote the promotion of the legitimacy of our government and the construction of democratic politics. It urges our government to change from "official standard" to "people first position" and help government to provide public goods better for citizens. The second part analyzes the evolution of the relationship between civil society and government, the relationship between the ought to be and the actual path of civil society participating in the governance of public affairs. The relationship between civil society and government in China has evolved from the earliest government control civil society to the relationship of independence, equality, mutual trust and cooperation between the government and civil society. At present, civil society participates in the cooperative governance of public affairs mainly through participating in policy making, providing public goods and coordinating interest relations. The third part summarizes the realistic predicament of civil society construction and the lack of government responsibility. In the process of civil society construction, it is difficult to guarantee its non-government character, the autonomy of operation is not sufficient, the management and supervision is not standard, and the plurality of organization is not enough. The government fails to provide favorable culture, system, legal environment and balanced financial support for the development of civil society in the construction of civil society. The fourth part explains the responsibility that the government should undertake in the construction of civil society: to construct modern political culture, to provide favorable cultural environment for civil society, to perfect the construction of democracy and legal system, to provide favorable institutional environment for civil society; To promote the process of government good governance, to provide a favorable administrative environment for civil society, to balance the financial support, and to provide strong resources for civil society.
