【摘要】：1949年10月1日,新中國(guó)成立,中國(guó)共產(chǎn)黨由一個(gè)革命黨轉(zhuǎn)變成為一個(gè)執(zhí)政黨。在中國(guó)共產(chǎn)黨的領(lǐng)導(dǎo)下,少數(shù)民族地區(qū)先后建立了不同行政等級(jí)的民族自治地方共計(jì)155個(gè),包括5個(gè)自治區(qū)、30個(gè)自治州、120個(gè)自治縣(旗)。在執(zhí)政過(guò)程中,中國(guó)共產(chǎn)黨需要把執(zhí)政黨的民族政策通過(guò)立法的途徑轉(zhuǎn)變?yōu)榉煞ㄒ?guī)在民族地區(qū)予以推行。憲法以根本法的形式確定了民族區(qū)域自治作為我國(guó)的一項(xiàng)基本政治制度;《民族區(qū)域自治法》作為民族立法的里程碑,為我國(guó)實(shí)現(xiàn)各民族平等、團(tuán)結(jié)和共同繁榮提供了強(qiáng)而有力的保障。 在中國(guó)共產(chǎn)黨的正確領(lǐng)導(dǎo)下,在全國(guó)人民的共同努力下,我國(guó)順利完成了黨的十五大提出的到2010年形成中國(guó)特色社會(huì)主義法律體系的立法工作目標(biāo)。2011年1月24日,全國(guó)人大常委會(huì)辦公廳舉行“形成中國(guó)特色社會(huì)主義法律體系座談會(huì)”,認(rèn)真總結(jié)了形成中國(guó)特色社會(huì)主義法律體系的基本經(jīng)驗(yàn)。民族地區(qū)的法律法規(guī)作為中國(guó)特色社會(huì)主義法律體系的重要組成部分,緊緊圍繞貫徹落實(shí)民族區(qū)域自治這項(xiàng)基本政策,形成了具有中國(guó)特色的民族法律法規(guī)體系。 本文從法制建設(shè)的角度來(lái)研究黨史,以建國(guó)以來(lái)中共的民族區(qū)域自治政策為主導(dǎo),以民族地區(qū)的法制建設(shè)為主體展開(kāi)論述,通過(guò)對(duì)民族區(qū)域自治與時(shí)俱進(jìn)的研究,期待能為社會(huì)主義法治社會(huì)和和諧社會(huì)建設(shè)以及中國(guó)特色民族法律體系的完善,提供政策咨詢意見(jiàn)。
[Abstract]:October 1, 1949, the founding of New China, the Communist Party of China from a revolutionary party to a ruling party. Under the leadership of the Communist Party of China, a total of 155 autonomous areas of different administrative levels have been established in ethnic minority areas, including 5 autonomous regions, 30 autonomous prefectures and 120 autonomous counties. In the process of ruling, the Communist Party of China needs to change the national policy of the ruling party into laws and regulations to be carried out in minority areas. The Constitution defines regional national autonomy as a basic political system in China, and the Law on Regional National Autonomy, as a milestone of national legislation, provides equality for all ethnic groups in China. Solidarity and common prosperity provide strong and powerful guarantees. Under the correct leadership of the Communist Party of China and with the concerted efforts of the people of the whole country, China has successfully completed the legislative work target of forming a socialist legal system with Chinese characteristics set by the 15th National Congress of the Party by 2010. On January 24, 2011, The General Office of the standing Committee of the National people's Congress held a "Symposium on the formation of Socialist legal system with Chinese characteristics", which conscientiously summed up the basic experience in forming the legal system of socialism with Chinese characteristics. As an important part of the legal system of socialism with Chinese characteristics, the laws and regulations of ethnic regions closely revolve around the implementation of the basic policy of regional autonomy of ethnic groups and form a system of laws and regulations with Chinese characteristics. This paper studies the history of the Party from the angle of legal system construction, taking the policy of ethnic regional autonomy of the Communist Party of China (CPC) since the founding of the people's Republic of China as the leading factor, and taking the legal system construction of ethnic areas as the main body, through the research on the national regional autonomy advancing with the times. It is expected to provide policy advice for the construction of socialist society ruled by law and harmonious society, as well as the perfection of national legal system with Chinese characteristics.
