【摘要】：伴隨著經(jīng)濟(jì)體制改革的深入進(jìn)行,我國(guó)的社會(huì)結(jié)構(gòu)也發(fā)生了巨大的變化,與此同時(shí),傳統(tǒng)的社會(huì)控制方式逐漸開始凸顯其局限性。這時(shí),社會(huì)管理體制創(chuàng)新作為一個(gè)嶄新的命題開始走進(jìn)人們的視野范圍內(nèi)。而社區(qū)自治作為社會(huì)管理體制創(chuàng)新重要內(nèi)容之一逐漸成為學(xué)術(shù)屆研討的熱點(diǎn)。社區(qū)自治是指社區(qū)居民在遵守法律和社區(qū)自治章程的前提下通過自我管理、自我教育、自我服務(wù)、自我監(jiān)督來處理涉及到自身的事務(wù)。 本文認(rèn)為,社區(qū)自治權(quán)應(yīng)當(dāng)包括人事自治、財(cái)務(wù)自治、服務(wù)自治、管理自治和教育自治等五項(xiàng)內(nèi)容。面對(duì)現(xiàn)階段我國(guó)社區(qū)自治陷入的困境,解決之道在于將社區(qū)進(jìn)一步界定現(xiàn)代商品房小區(qū),同時(shí)由業(yè)主委員會(huì)逐步取代居民委員會(huì)的職能而成為社區(qū)自治的主導(dǎo)機(jī)構(gòu)。 本文認(rèn)為,理想中的社區(qū)自治模型可以概括為“五項(xiàng)、四權(quán)、兩選、一聘、三公開”。對(duì)社區(qū)自治的救濟(jì)應(yīng)當(dāng)包括三個(gè)方面的內(nèi)容：其一,完善對(duì)業(yè)主委員會(huì)成員的罷免程序并逐步取消物業(yè)管理?xiàng)l例設(shè)置的過高的門檻規(guī)定；其二,擴(kuò)大行政訴訟的受案范圍,使得行政指導(dǎo)行為依法納入司法審查的范疇；其三,將社區(qū)黨總支逐漸建設(shè)成社區(qū)自治選舉糾紛的仲裁機(jī)構(gòu)。 通過這種模式,社區(qū)自治主導(dǎo)機(jī)構(gòu)可以有效解決日趨行政化的怪圈,社區(qū)居民將能夠更加廣泛的參與到基層民主建設(shè)中。屆時(shí),具有中國(guó)特色的社會(huì)主義基層民主建設(shè)將成功建成,公民們將真正實(shí)現(xiàn)知情權(quán)、參與權(quán)、表達(dá)權(quán)和監(jiān)督權(quán),中國(guó)特色社會(huì)主義民主政治的優(yōu)越性也必將釋放出更加絢麗奪目的光芒。
[Abstract]:With the deepening of the economic system reform, the social structure of our country has also undergone tremendous changes, at the same time, the traditional social control mode gradually began to highlight its limitations. At this time, social management system innovation as a new proposition began to enter the scope of vision. As one of the important contents of social management system innovation, community autonomy has gradually become a hot topic in academic research. Community autonomy means that community residents deal with their own affairs through self-management, self-education, self-service and self-supervision under the premise of abiding by the law and community autonomy regulations. This paper holds that community autonomy should include five aspects: personnel autonomy, financial autonomy, service autonomy, management autonomy and educational autonomy. Facing the predicament of community autonomy in our country at present, the solution lies in further defining the community as the modern commercial housing district, and at the same time, the owners' committee gradually replaces the function of the residents' committee and becomes the leading institution of community autonomy. This paper holds that the ideal model of community autonomy can be summarized as "five terms, four powers, two elections, one appointment, three public". The relief to community autonomy should include three aspects: first, to perfect the recall procedure for the members of the owners' committee and to gradually abolish the excessive threshold set by the property management regulations; second, to expand the scope of accepting cases in administrative proceedings. The administrative guidance behavior is brought into the scope of judicial review according to law. Thirdly, the general branch of the community party is gradually built into an arbitration institution for autonomous election disputes in the community. Through this model, the leading institutions of community autonomy can effectively solve the increasingly administrative circles, community residents will be able to participate more widely in the grass-roots democratic construction. By then, the socialist grass-roots democratic construction with Chinese characteristics will be successfully built, and citizens will truly realize their right to know, to participate in, to express and to supervise. The superiority of socialist democratic politics with Chinese characteristics is bound to release a more brilliant ray of light.
