農(nóng)村行政信訪(fǎng)法治化出路研究

【摘要】:信訪(fǎng)是來(lái)信來(lái)訪(fǎng)的簡(jiǎn)稱(chēng)。農(nóng)村行政信訪(fǎng)是國(guó)家在特殊時(shí)期設(shè)立的輔助性糾紛解決機(jī)制,是在建設(shè)中國(guó)特色的社會(huì)主義道路中,處理公共權(quán)力與廣大農(nóng)村民眾關(guān)系的一種方式,其在政治參與與權(quán)利救濟(jì)兩方面發(fā)揮了重要的作用,但是也存在不少的問(wèn)題。解決農(nóng)村行政信訪(fǎng)中問(wèn)題的出路在于將行政信訪(fǎng)與法治相結(jié)合,走農(nóng)村行政信訪(fǎng)法治化道路。 本文第一部分簡(jiǎn)單闡述了農(nóng)村行政信訪(fǎng)的基本概念,分析了農(nóng)村行政信訪(fǎng)的基本功能,并提出了農(nóng)村行政信訪(fǎng)法治化問(wèn)題。 本文第二部分著重分析了農(nóng)村行政信訪(fǎng)現(xiàn)狀及法治化過(guò)程中面臨的問(wèn)題。通過(guò)對(duì)浙江省上虞市農(nóng)村行政信訪(fǎng)的實(shí)地調(diào)查,全面分析了農(nóng)村行政信訪(fǎng)總量依然居高不下、越級(jí)上訪(fǎng)形勢(shì)嚴(yán)峻、信訪(fǎng)內(nèi)容日趨豐富、信訪(fǎng)解決難度增大四個(gè)現(xiàn)狀特征。并透過(guò)現(xiàn)象查找本質(zhì),認(rèn)為造成當(dāng)前信訪(fǎng)法治化問(wèn)題嚴(yán)重的原因主要存在三個(gè)方面,一是制度層面,主要是執(zhí)法不到位,導(dǎo)致信訪(fǎng)制度的實(shí)施效果不理想;二是農(nóng)村行政信訪(fǎng)的主體之一農(nóng)民問(wèn)題,客觀上是農(nóng)民利益表達(dá)途徑不暢,也有農(nóng)民棄法信訪(fǎng)的主觀原因;三是農(nóng)村行政信訪(fǎng)的另一主體行政機(jī)關(guān),也存在許多自身不足,如鄉(xiāng)鎮(zhèn)信訪(fǎng)辦責(zé)重權(quán)輕、基層調(diào)處不力、信訪(fǎng)工作人員對(duì)信訪(fǎng)工作不重視、信訪(fǎng)工作人員素質(zhì)不高和隊(duì)伍不穩(wěn)定等問(wèn)題。 找到了原因,就要對(duì)癥下藥。本文第三部分以第二部分的問(wèn)題分析為基礎(chǔ),對(duì)現(xiàn)在農(nóng)村信訪(fǎng)非法治化現(xiàn)象提出了相應(yīng)的解決對(duì)策。筆者認(rèn)為,首先要完善機(jī)制,強(qiáng)化執(zhí)法力度,保障信訪(fǎng)制度的貫徹落實(shí),著力解決執(zhí)行不到位的問(wèn)題。其次,為了解決目前農(nóng)村信訪(fǎng)錯(cuò)位的問(wèn)題,必須加強(qiáng)法制大環(huán)境建設(shè),擴(kuò)大訴訟的權(quán)利救濟(jì)功能,積極發(fā)揮司法機(jī)關(guān)的主導(dǎo)作用,以進(jìn)一步弱化信訪(fǎng)的權(quán)利救濟(jì)功能,逐步恢復(fù)信訪(fǎng)政治參與的主要功能,即反映問(wèn)題、提出意見(jiàn)和建議。對(duì)于農(nóng)民,要大力加強(qiáng)法制宣傳和教育,使其懂法、守法,依法上訪(fǎng);而加快新農(nóng)村建設(shè),特別是加強(qiáng)村級(jí)基層組織建設(shè),就能從源頭上減少信訪(fǎng)矛盾和糾紛的發(fā)生。另外,由于鄉(xiāng)鎮(zhèn)信訪(fǎng)辦責(zé)重權(quán)輕,許多問(wèn)題根本無(wú)法解決,因此必須提高鄉(xiāng)鎮(zhèn)信訪(fǎng)辦的地位,賦予其更多的權(quán)力,為此,筆者借鑒國(guó)外申訴專(zhuān)員制度的成功經(jīng)驗(yàn),提出了以鄉(xiāng)鎮(zhèn)人大為主導(dǎo)的信訪(fǎng)模式,通過(guò)構(gòu)建新的機(jī)制,來(lái)解決目前鄉(xiāng)鎮(zhèn)信訪(fǎng)辦責(zé)重權(quán)輕的問(wèn)題。隨著法治化進(jìn)程的加快,可以相信,通過(guò)我們的努力,將逐步走出一條農(nóng)村行政信訪(fǎng)的法治化道路。
[Abstract]:Letters and visits are short for letters and visits. Rural administrative petition is an auxiliary dispute resolution mechanism established by the state in a special period. It is also a way to deal with the relationship between public power and rural people in the course of building socialism with Chinese characteristics. It plays an important role in political participation and right relief, but there are still many problems. The solution to the problem lies in the combination of administrative petition and rule of law, and the rule of law in rural administrative petition. The first part of this paper briefly expounds the basic concept of rural administrative letters and visits, analyzes the basic functions of rural administrative letters and visits, and puts forward the issue of the legalization of rural administrative letters and visits. The second part of this paper focuses on the analysis of the status quo of rural administrative petition and the problems faced in the process of ruling by law. Through the field investigation of the rural administrative letters and visits in Shangyu City, Zhejiang Province, the paper comprehensively analyzes the four characteristics of the present situation: the total amount of the rural administrative letters and visits is still high, the situation of petition and petition leapfrogging is severe, the contents of the letters and visits are increasingly abundant, and the difficulty of resolving the letters and visits increases. And through the phenomenon to find out the essence, think that there are three main reasons that cause the serious problem of legalization of letters and visits, one is the system level, mainly law enforcement is not in place, resulting in the implementation of the petition system is not ideal; Second, the issue of peasants, one of the main bodies of rural administrative petitions and visits, is objectively due to the poor expression of farmers' interests and the subjective reasons for peasants to abandon the law. Third, the other main administrative organ of rural administrative letters and visits also has many shortcomings of its own. For example, the township office of letters and visits pays less attention to the responsibility and power, the basic level of mediation is weak, the staff of letters and visits do not attach importance to the work of letters and visits, the quality of the staff of letters and visits is not high and the ranks are unstable, and so on. If you find the cause, you must prescribe the right medicine. In the third part, based on the problem analysis of the second part, the author puts forward the corresponding countermeasures to the phenomenon of non-legalization of petition and visit in rural areas. The author thinks that first of all, we should perfect the mechanism, strengthen the law enforcement, guarantee the implementation of the letter and visit system, and solve the problem that the execution is not in place. Secondly, in order to solve the problem of mismatch of petition and visit in rural areas, we must strengthen the construction of legal environment, expand the function of right relief of litigation, and actively exert the leading role of judicial organs in order to further weaken the right relief function of letters and visits. Gradually restore the main function of political participation in letters and visits, that is, reflect problems, put forward opinions and suggestions. For farmers, we should vigorously strengthen publicity and education on the legal system, make them understand the law, abide by the law, and petition according to law; and speeding up the construction of new rural areas, especially the building of grass-roots organizations at the village level, can reduce the occurrence of conflicts and disputes between letters and visits at the source. In addition, many problems can not be solved because the responsibility of the township office of letters and visits is less than the responsibility. Therefore, it is necessary to improve the status of the township office of letters and visits and endow it with more power. Therefore, the author draws lessons from the successful experience of the Ombudsman system of foreign countries. This paper puts forward the mode of letters and visits dominated by the township people's Congress, and solves the problem of paying more attention to the responsibility of the township letters and visiting offices than to the power through the construction of a new mechanism. With the acceleration of the process of rule by law, we can believe that through our efforts, we will step by step out of a rural administrative petition of the rule of law road.
