【摘要】：法制現(xiàn)代化論題始終需要置于現(xiàn)代性語境中予以闡釋。后現(xiàn)代社會的形成,現(xiàn)代性的反思性日益凸顯,構(gòu)架現(xiàn)代性制度之維的現(xiàn)代法律和司法,需要因應現(xiàn)代性的反思性要求。反思現(xiàn)代性既是對理性前提預設的追問和重釋,又在向世界蔓延過程中遵循實踐邏輯表現(xiàn)為多元現(xiàn)代性狀態(tài)。中國的法治道路既是對西方法治理念的反思,也是對自身傳統(tǒng)的重釋。在司法層面,中國法制現(xiàn)代化的反思性要求從方法論上入手,從具體的案件審理切入,將案件審理作為漸進式推進中國法制現(xiàn)代化的重要方案。
[Abstract]:The topic of legal modernization always needs to be explained in the context of modernity. With the formation of post-modern society, the reflection of modernity is becoming more and more prominent. The modern law and judicature, which frame the dimension of modern system, need to meet the reflective requirements of modernity. Reflection on modernity is not only a question and a reinterpretation of the presupposition of rational premise, but also a pluralistic modernity state in the process of spreading to the world in accordance with the practical logic. The road of rule of law in China is not only a reflection on the idea of western rule of law, but also a reinterpretation of its own tradition. At the judicial level, the reflection of the modernization of China's legal system requires starting with methodology, cutting into concrete cases, and taking the trial of cases as an important scheme to gradually promote the modernization of China's legal system.
