【摘要】：當(dāng)今世界，國家軟實(shí)力已經(jīng)成為一國綜合國力的重要因素，法治文化居于國家軟實(shí)力的核心地位，搞好法治文化建設(shè)對于提升國家軟實(shí)力和綜合國力具有重大的現(xiàn)實(shí)意義。當(dāng)前學(xué)界，，對于法治文化和國家軟實(shí)力的研究給予了越來越多的關(guān)注，而從國家軟實(shí)力的視角研究法治文化的理論還很薄弱。論文力求從國家軟實(shí)力這一視角來解讀法治文化的價(jià)值。本文主要以“國家軟實(shí)力”與“法治文化”兩個(gè)基本概念的關(guān)系入手，為全文打下理論基礎(chǔ)，然后重點(diǎn)分析法治文化在提升國家軟實(shí)力中的價(jià)值，以及在這一視角下法治文化發(fā)揮其價(jià)值的作用機(jī)理，最后，分析國家軟實(shí)力視角下我國法治文化建設(shè)的若干思考。本文共分五章: 第一章：主要分析了研究的緣起和意義、研究的現(xiàn)狀及評述、研究的思路與方法以及研究的重點(diǎn)、難點(diǎn)與創(chuàng)新點(diǎn)。 第二章：主要分析了法治文化的涵義、特征、構(gòu)成要素，國家軟實(shí)力的概念及表現(xiàn)形式，為進(jìn)而探討法治文化與國家軟實(shí)力的關(guān)系作鋪墊。 第三章：主要分析了國家軟實(shí)力視角下法治文化的價(jià)值，表現(xiàn)在四個(gè)方面：法治文化是提升民族凝聚力的重要源泉；法治文化是體現(xiàn)文化吸引力的關(guān)鍵因素；法治文化是維持國家影響力的有力工具；法治文化有助于增強(qiáng)外交的親和力。 第四章：主要分析了法治文化提升國家軟實(shí)力的作用機(jī)理，表現(xiàn)在三個(gè)方面：法治文化將保障人權(quán)轉(zhuǎn)化為國家意識、將治理活動(dòng)轉(zhuǎn)化為和諧建設(shè)、將法律約束轉(zhuǎn)化為法治崇尚。 第五章：主要分析了國家軟實(shí)力視角下我國法治文化建設(shè)的若干思考，探討在此視角下法治文化建設(shè)存在的問題：法治精神缺失；法制宣傳教育存在著偏差；法治文化發(fā)展沒有得到足夠的重視；法治文化環(huán)境建設(shè)滯后。最后針對現(xiàn)存的問題提出自己的建議。
[Abstract]:In today's world, national soft power has become an important factor of a country's comprehensive national strength, and the culture of rule of law occupies the core position of national soft power. It is of great practical significance to improve the construction of national soft power and comprehensive national power by doing a good job in the construction of the culture of rule of law. At present, scholars pay more and more attention to the study of the culture of rule of law and the soft power of the country, but the theory of studying the culture of the rule of law from the perspective of national soft power is still very weak. The paper tries to interpret the value of the culture of rule of law from the perspective of national soft power. This article mainly starts with the relationship between the two basic concepts of "national soft power" and "culture of rule of law", and lays a theoretical foundation for the full text, and then analyzes the value of the culture of rule of law in promoting national soft power. Finally, the author analyzes some thoughts on the construction of China's legal culture from the perspective of soft power. This paper is divided into five chapters: The first chapter mainly analyzes the origin and significance of the research, the present situation and comments of the research, the ideas and methods of the research, the key points of the research, the difficulties and the innovation points. The second chapter mainly analyzes the meaning, characteristics, elements of the culture of rule of law, the concept and manifestation of national soft power, which lays the groundwork for further discussion of the relationship between the culture of rule of law and the soft power of the country. The third chapter mainly analyzes the value of the culture of rule of law in the view of national soft power, which is manifested in four aspects: the culture of rule of law is an important source of national cohesion, the culture of rule of law is the key factor to reflect the attraction of culture; The culture of rule of law is a powerful tool to maintain the influence of the state, and the culture of rule of law helps to strengthen the affinity of diplomacy. The fourth chapter mainly analyzes the function mechanism of the culture of rule of law to promote the soft power of the country, which is manifested in three aspects: the culture of rule of law transforms the protection of human rights into the consciousness of the country, the activity of governance into the construction of harmony, and the restriction of law into the worship of the rule of law. The fifth chapter mainly analyzes some thoughts on the construction of the culture of rule of law under the view of national soft power, and discusses the problems in the construction of the culture of rule of law in this perspective: the lack of spirit of rule of law, the deviation of propaganda and education of legal system; The development of the culture of rule of law has not received enough attention, and the construction of the cultural environment of the rule of law lags behind. Finally, the author puts forward his own suggestions for the existing problems.
