【摘要】:改革開放三十多年來,中國農(nóng)村走出了新老兩代農(nóng)民工。目前,新生代農(nóng)民工數(shù)量接近1億,已經(jīng)成為農(nóng)民工的主流群體。這一龐大群體對我國現(xiàn)代化和城市化的進(jìn)程產(chǎn)生了深刻而巨大的影響。中央“一號文件”傳遞出黨和政府對于新生代農(nóng)民工的高度關(guān)注。加強(qiáng)新生代農(nóng)民工的法制教育研究,切實(shí)解決農(nóng)民工問題,對構(gòu)建和諧社會,推動我國法治進(jìn)程,建設(shè)社會主義法治國家,具有重要意義。 本文通過問卷調(diào)查的實(shí)證研究方法,對新生代農(nóng)民工的法制教育問題進(jìn)行了相關(guān)研究,從以下幾個方面進(jìn)行了論述。 引言部分,本文首先梳理農(nóng)民工的發(fā)展歷史,交代了新生代農(nóng)民工產(chǎn)生的歷史背景,以凸顯新生代農(nóng)民工的時代特色;其次,敘述了社會主義法制教育在思想政治教育中的重要作用,以及做好新生代農(nóng)民工法制教育工作的重要意義;最后,本章節(jié)還對新生代農(nóng)民工的法制教育研究現(xiàn)狀做了概述,指出了本文的研究方法、研究目的、研究意義、和創(chuàng)新之處。 本文分為四個部分:第一部分,界定了新生代農(nóng)民工的內(nèi)涵和特征。首先從農(nóng)民工發(fā)展的歷史入手,指出目前中國農(nóng)民工正處于新老兩代代際更替的時期,新生代農(nóng)民工已經(jīng)逐漸登上了時代發(fā)展的大舞臺;其次,通過問卷調(diào)查的方法,一方面將新生代農(nóng)民工和老一代農(nóng)民工進(jìn)行縱向比較,得出新生代農(nóng)民較之老一代有著較高的受教育水平、較強(qiáng)的維權(quán)意識以及追求自由平等的自覺性;另一方面將新生代農(nóng)民工和城市新生代進(jìn)行橫向比較,從而分析出,新生代農(nóng)民工由于沒有接受過高等教育,缺乏專業(yè)技能,羸弱的競爭力只允許他們進(jìn)入非正規(guī)就業(yè)市場,由此他們過高的期望與非正規(guī)就業(yè)市場提供的低劣的城市生存條件,形成了巨大的落差。 第二部分,論述了新生代農(nóng)民工法制教育缺失的表現(xiàn)。本部分首先描述了我國從“一五”普法到“五五”普法的法制教育歷程,指出在我國法制教育現(xiàn)狀下,針對新生代農(nóng)民工的法制教育還存在一些不足。然后詳細(xì)列舉了新生代農(nóng)民工法制教育缺失的表現(xiàn),具體為:法律知識匱乏、教育內(nèi)容不合理及方法滯后。最后,指出了法制教育缺失所帶來的正反兩方面的后果:即新生代農(nóng)民工權(quán)利受到侵害無法維護(hù)以及他們遵紀(jì)守法的意識不強(qiáng)。 第三部分,從自身和外部兩方面,分析了造成新生代農(nóng)民工法制教育缺失的原因。其中,自身原因主要是新生代農(nóng)民工自小受到農(nóng)村宗法等級制度、司法行政合一、德主刑輔禮治的傳統(tǒng)思想影響,對法律缺乏了解,加之他們在鄉(xiāng)村中學(xué)接受義務(wù)教育時,并沒有受到普法的恩澤,對法律更是知之甚少;外部原因主要是受重視程度不夠、法制教育經(jīng)費(fèi)不足、教育工作落實(shí)不到位等。第四部分,根據(jù)問卷調(diào)查的數(shù)據(jù)分析,本文提出了一些關(guān)于增強(qiáng)新生代農(nóng)民工法制教育的對策和建議,具體包括以下幾個重要方面:一,加大相關(guān)立法力度;二,明確責(zé)任劃分;三,合理設(shè)置法制教育內(nèi)容,主要包括改變以往對農(nóng)民工重義務(wù)輕權(quán)利及重實(shí)體輕程序的教育模式;四,全方位多渠道進(jìn)行普法教育,將法制教育與職業(yè)技能培訓(xùn)和法律服務(wù)結(jié)合起來;五,改革法制教育的方法,實(shí)現(xiàn)法制教育信息化和網(wǎng)絡(luò)化。 結(jié)論:總結(jié)全文,點(diǎn)明加強(qiáng)新生代農(nóng)民工法制教育的重要意義,并簡要說明筆者寫這篇文章的初衷。
[Abstract]:With the reform and opening - up for more than 30 years , China ' s rural migrant workers have come out of the new and old peasant workers . At present , the number of migrant workers in the new generation is close to 100 million , which has become the mainstream group of migrant workers .
This paper studies the legal education of the new generation migrant workers through the empirical research method of the questionnaire , and discusses them from the following aspects .
In the introduction part , this paper first sorts out the development history of the migrant workers and the historical background of the new generation of migrant workers , which highlights the important role of the socialist legal education in the ideological and political education , and also gives an overview of the present situation of the legal education of the new generation migrant workers , and points out the research methods , research purposes , research significance and innovation .
This paper is divided into four parts : the first part , defines the connotation and characteristics of the new generation migrant workers . First of all , from the history of the development of migrant workers , it is pointed out that the new generation of migrant workers has gradually reached the stage of the development of the times .
The second part discusses the lack of legal education in the new generation migrant workers . The fourth part , according to the data analysis of the questionnaire , puts forward some countermeasures and suggestions on strengthening the legal education of migrant workers in the new generation .
Conclusion : To sum up the whole text , point out the importance of strengthening the legal education of new generation migrant workers , and briefly explain the author ' s original intention to write this article .
