【摘要】：在法治與體育行業(yè)自治關(guān)系的研究上,"介入說"和"自治說"以及積極性合作式路徑都缺少反思性思維,忽視了這些路徑可能產(chǎn)生的負(fù)效應(yīng)影響。反思性合作受啟于反思法理論和"合作治理"理論,是對二者的吸收與超越。在中國語境下,法治與體育行業(yè)自治應(yīng)該建立在一種反思性合作關(guān)系之上。據(jù)此,反思性思維將主導(dǎo)合作關(guān)系,間接性合作將成為主導(dǎo)的合作路向,在此基礎(chǔ)上構(gòu)建具體的反思性合作制度。既可通過自治來實現(xiàn)合作,還可以通過設(shè)定用盡內(nèi)部救濟(jì)原則、法院的有限度介入和內(nèi)部救濟(jì)司法化等方面的間接規(guī)制來實現(xiàn)合作。中國足球協(xié)會在機(jī)構(gòu)建制和制度建制方面的努力在某種程度上實現(xiàn)了內(nèi)部的分工自治,但存在與政府的依賴性合作、行業(yè)自治被壓縮與變形、絕對拒斥與司法權(quán)的合作、內(nèi)部救濟(jì)司法化建制不力等問題。對此,問題的具體解決思路應(yīng)以反思性合作思維來設(shè)計。
[Abstract]:In the study of the relationship between the rule of law and the autonomy of the sports industry, the "intervention theory" and "autonomy theory" and the positive and cooperative path lack of reflective thinking, ignoring the possible negative effects of these paths. Reflective cooperation is absorbed and transcended by the theory of reflective law and cooperative governance. In Chinese context, the rule of law and sports autonomy should be based on a reflective cooperative relationship. On this basis, reflective thinking will dominate the cooperative relationship, indirect cooperation will become the leading direction of cooperation, and on this basis, the specific reflective cooperation system will be constructed. Cooperation can be realized not only through autonomy, but also by setting up the principle of exhaustion of internal remedies, the limited intervention of the court and the indirect regulation of the judicial system of internal relief. To a certain extent, the Chinese Football Association has realized the internal division of labor autonomy in the institutional and institutional systems, but there are dependent cooperation with the government, the industry autonomy has been compressed and transformed, and absolutely rejected the cooperation with the judicial power. The internal relief judicial system is weak and so on. Therefore, the concrete solution of the problem should be designed by reflective cooperative thinking.
