【摘要】：隨著簡(jiǎn)政放權(quán)、政府職能轉(zhuǎn)變的深化,單純實(shí)施的行政審批制度改革的邊際效益不斷降低,更加系統(tǒng)性的"放管服"改革全面推行。實(shí)現(xiàn)"放管服"改革目標(biāo)的關(guān)鍵因素之一,在于通過(guò)對(duì)行政審批自由裁量具體形態(tài)進(jìn)行解構(gòu),將體現(xiàn)正當(dāng)善意的行政審批自由裁量進(jìn)行法治規(guī)訓(xùn),進(jìn)而納入政務(wù)服務(wù)范式。正當(dāng)善意自由裁量的核心,在于促使政府機(jī)構(gòu)及其工作人員積極地從實(shí)際情況和需要出發(fā),依法負(fù)責(zé)任、創(chuàng)新性地行使職權(quán),使申請(qǐng)人得到既原則又靈活、既規(guī)范又便捷的主動(dòng)服務(wù),實(shí)現(xiàn)公益與私益相得的行政預(yù)期增值。換言之,政務(wù)服務(wù)范式的行政審批自由裁量,是法治基準(zhǔn)與服務(wù)取向的均衡,是依規(guī)許可與依需辦理的統(tǒng)一,體現(xiàn)了實(shí)質(zhì)與形式兼顧的法律理性。
[Abstract]:With the decentralization of government and the deepening of the transformation of government functions, the marginal benefit of the reform of administrative examination and approval system which is simply implemented has been continuously reduced, and the more systematic reform of "release of management and service" has been carried out in an all-round way. One of the key factors to realize the reform goal of "release management service" lies in the deconstruction of the specific form of administrative examination and approval discretion, which will embody the legitimate and well-intentioned administrative examination and approval discretion and discipline the rule of law, and then bring it into the pattern of government affairs service. The core of the legitimate bona fide discretion lies in enabling government agencies and their staff to actively act in accordance with the actual situation and needs, to exercise their functions responsibly and creatively in accordance with the law, so that the applicant can be both principled and flexible, Both standardized and convenient active service to achieve the public and private benefits of administrative expectations added value. In other words, the discretion of administrative examination and approval in the paradigm of government affairs service is the balance between the criterion of rule of law and the orientation of service, and the unification of permission according to regulations and handling according to needs, which embodies the legal rationality which takes both substance and form into account.
