【摘要】：西方法治理念的形成是伴隨著西方資本主義制度的產生、演變以及鞏固而發(fā)展起來的。西方法治理念源遠流長,體現在很多的理論和學說中,西方法治理念對我國法治理念提供了重要的參考。 西方法治理念和社會主義法治理念建立在不同的社會經濟基礎之上,具有不同的內涵和外延。通過對比兩者的區(qū)別,會清醒地認識社會主義法治理念自身的特點。西方法治理念是一個完整的體系,但是它并不是完全適合我國的社會主義法治建設。我們應該在馬克思主義的指導下,結合我國的實際國情,全面地分析西方法治理念對社會主義法治觀教育的積極影響和消極影響,揚長避短,使社會法治理念具有更強的時代性和生命力。 西方法治理念具有一定的局限性,因此我們不能完全地照搬西方的法治理念。一方面要反思我國目前法治理念教育存在的問題,看到我國法治理念教育的不足,在這個基礎上,借鑒西方法治理念中的合理因素;另一方面,要開創(chuàng)具有中國特色的社會主義法制觀教育,使社會主義法制觀建設能更好地適應我國的經濟、政治和文化的發(fā)展水平。
[Abstract]:The formation of the western concept of rule of law is accompanied by the emergence, evolution and consolidation of the western capitalist system. The western concept of rule of law has a long history and is embodied in many theories and theories. It provides an important reference for the concept of rule of law in our country. The western concept of rule of law and the idea of socialist rule of law are based on different social and economic foundations and have different connotations and denotations. By comparing the difference between the two, we will soberly understand the characteristics of the socialist concept of rule of law. The idea of western rule of law is a complete system, but it is not completely suitable for the construction of socialist rule of law in our country. Under the guidance of Marxism, we should comprehensively analyze the positive and negative effects of the western concept of rule of law on the education of socialist view of rule of law, combining with the actual conditions of our country, so as to make the best of our strengths and avoid our weaknesses. The concept of social rule of law has a stronger sense of the times and vitality. The western concept of rule of law has some limitations, so we can not completely copy the western concept of rule of law. On the one hand, we should reflect on the existing problems in the education of the concept of rule of law in our country, and see the deficiency of the education of the concept of rule of law in our country. It is necessary to initiate the education of socialist legal concept with Chinese characteristics so that the construction of socialist legal concept can better adapt to the level of economic, political and cultural development of our country.
