【摘要】： 改革開放以來,隨著我國經(jīng)濟的迅猛發(fā)展,農(nóng)村環(huán)境污染問題日益顯現(xiàn),嚴重影響了農(nóng)村經(jīng)濟、社會及生態(tài)的發(fā)展,阻礙了社會主義新農(nóng)村建設(shè)的順利進行。加強農(nóng)村環(huán)境保護,防治農(nóng)村環(huán)境污染,是目前我省新農(nóng)村建設(shè)的當務(wù)之急,也是全面建設(shè)小康社會的迫切要求。因此,針對我省農(nóng)村環(huán)境污染的特殊性和農(nóng)村環(huán)境污染防治法治建設(shè)滯后的現(xiàn)狀,強化農(nóng)村環(huán)境污染防治的法治手段顯得尤為重要。 本文在現(xiàn)有研究的基礎(chǔ)上,著重從法治的角度探究我省的農(nóng)村環(huán)境污染問題,提出了一系列具有建設(shè)性的對策建議。筆者以厘清相關(guān)概念、闡述農(nóng)村環(huán)境污染防治法治化的相關(guān)理論依據(jù)為起點,通過對農(nóng)村環(huán)境污染狀況的現(xiàn)實剖析,揭示了農(nóng)村環(huán)境污染的根源所在；進而針對現(xiàn)存問題,從法治的視角揭示了現(xiàn)有農(nóng)村環(huán)境立法、執(zhí)法、司法、守法、法律監(jiān)督等方面存在的弊端,深刻闡述了如何完善我國農(nóng)村環(huán)境法治建設(shè)。文章同時期望能夠從國外農(nóng)村環(huán)境法治建設(shè)中吸取營養(yǎng),“洋為中用”,豐富我國農(nóng)村環(huán)境法治手段,試圖提出一種適合我省乃至全國農(nóng)村實際需要的法治化模式,以期建立一個環(huán)境友好、法治健全的社會主義新農(nóng)村。
[Abstract]:Since the reform and opening up, with the rapid development of China's economy, the problem of environmental pollution in rural areas has become increasingly apparent, seriously affecting the development of rural economy, society and ecology, and hindering the smooth progress of the construction of a new socialist countryside. Strengthening rural environmental protection and preventing rural environmental pollution are the urgent affairs of the construction of new countryside in our province at present, and are also the urgent requirements of building a well-off society in an all-round way. Therefore, in view of the particularity of rural environmental pollution in our province and the lagging construction of rural environmental pollution prevention and control rule of law, it is particularly important to strengthen the legal means of rural environmental pollution prevention and control. Based on the existing research, this paper probes into the problem of rural environmental pollution in our province from the point of view of rule of law, and puts forward a series of constructive countermeasures and suggestions. In order to clarify the relevant concepts, expound the relevant theoretical basis of environmental pollution prevention and control in rural areas, through the realistic analysis of the rural environmental pollution situation, the author reveals the source of rural environmental pollution, and then aims at the existing problems. From the perspective of the rule of law, this paper reveals the shortcomings of the existing rural environmental legislation, law enforcement, judicature, law-abiding and legal supervision, and expounds how to perfect the construction of rural environmental rule of law in China. At the same time, the article expects to be able to absorb the nutrition from the construction of the rural environmental rule of law in foreign countries, to enrich the means of rural environmental rule of law in our country, and to try to put forward a mode of rule of law suitable for the actual needs of the rural areas of our province and even the whole country. With a view to building a friendly environment, the rule of law sound socialist new countryside.
