【摘要】：在"著力加強(qiáng)供給側(cè)結(jié)構(gòu)性改革"的背景下,重新探討20世紀(jì)90年代以來社會熱議的宏觀調(diào)控中的"央地互動"問題具有現(xiàn)實(shí)意義。在法治語境下,宏觀調(diào)控中的"央地互動",從靜態(tài)看,是中央政府與地方政府在宏觀調(diào)控中的權(quán)力、利益和責(zé)任的配置問題;從動態(tài)看,是中央政府與地方政府在宏觀調(diào)控中的利益沖突、權(quán)力沖突時(shí)的行為規(guī)范問題。"央地互動"的消極影響顯而易見,但"央地互動"的積極影響也值得珍視。發(fā)揮"央地互動"積極效應(yīng),抑制其消極后果,必須依靠法治。完善調(diào)整宏觀調(diào)控中央地關(guān)系的法律制度,通過更明確的分權(quán)、更合理的博弈規(guī)則、更科學(xué)的宏觀調(diào)控執(zhí)行機(jī)制以及更有力的法律責(zé)任制度來規(guī)范和引導(dǎo)"央地互動",同時(shí),規(guī)范和引導(dǎo)社會力量制約和均衡政府權(quán)力。
[Abstract]:Under the background of "strengthening supply-side structural reform", it is of practical significance to re-discuss the issue of "central-land interaction" in the social heated macro-control since the 1990s. In the context of the rule of law, the "central-land interaction" in macro-control is the allocation of power, interests and responsibilities between the central government and the local government in macro-control from the static point of view, and from the dynamic point of view, It is the conflict of interest between the central government and the local government in macroeconomic regulation and control, and the problem of the standard of conduct during the conflict of power. " The negative effects of central interaction are obvious, but the positive effects of central interaction are also worth cherishing. It is necessary to rely on the rule of law to exert the positive effect of "central interaction" and restrain its negative consequences. To perfect and adjust the legal system of macro-control of the relationship between central and local areas, to standardize and guide "central and local interaction" through clearer separation of powers, more reasonable rules of game, more scientific implementation mechanism of macro-control and enforcement and more effective legal responsibility system. Regulate and guide social forces to restrict and balance government power.
