【摘要】： 信訪制度是一個(gè)典型的具有中國(guó)特色的制度,它產(chǎn)生于國(guó)家政權(quán)建立之初,在國(guó)家實(shí)行法治的背景下仍繼續(xù)存在并發(fā)揮作用。不可否認(rèn),信訪制度曾在中國(guó)相當(dāng)長(zhǎng)的時(shí)期被賦予了各種不同的功能,承擔(dān)了重要的歷史使命,完成了國(guó)家許多階段性的任務(wù)。直至今天,對(duì)于廣大社會(huì)弱勢(shì)群眾來說,他們?nèi)园研旁L制度看成是實(shí)現(xiàn)權(quán)利救濟(jì)的重要途徑之一。但是,在民主化和法治化的語境下,現(xiàn)行的信訪制度暴露出許多的缺陷和面臨嚴(yán)重的困境。信訪制度自身的立法現(xiàn)狀和運(yùn)行現(xiàn)狀暴露出現(xiàn)行信訪制度的諸多問題,信訪制度自身的比較濃厚的人治色彩及信訪功能的變異使得信訪制度陷入困境。信訪制度自產(chǎn)生以來始終是運(yùn)行在法治的框架之外,信訪制度這種人治色彩比較濃厚的制度設(shè)計(jì)與法治理念產(chǎn)生了極大的矛盾和沖突。因此,對(duì)信訪制度進(jìn)行反思與重構(gòu)就有了必要。本文以信訪制度的基本理論為研究起點(diǎn),探討信訪制度的內(nèi)涵、功能及產(chǎn)生的基礎(chǔ),接下來從立法及運(yùn)行兩個(gè)層面對(duì)信訪制度的現(xiàn)狀進(jìn)行詳細(xì)的論述,然后在法治語境下對(duì)信訪制度進(jìn)行反思,對(duì)其合理性及面臨的困境進(jìn)行充分論證與深入分析,最后對(duì)法治語境下的信訪制度進(jìn)行重構(gòu),對(duì)其進(jìn)行理論思考、功能定位并提出具體的法治化重構(gòu)方式。
[Abstract]:The system of letters and visits is a typical system with Chinese characteristics. It emerged from the beginning of the establishment of the state power, and it still exists and plays a role in the background of the implementation of the rule of law in the country. Undeniably, the petition system was endowed with various functions in China for a long time, undertook an important historical mission, and completed many stages of the tasks of the country. To this day, they still regard the petition system as one of the important ways to realize the right relief. However, in the context of democratization and rule of law, the current petition system exposes many defects and faces serious difficulties. The present situation of legislation and operation of the petition system exposes many problems in the current system of petition and visitation. The strong color of the rule of man and the variation of the function of the petition system make the system of letters and visits fall into difficulties. The system of letters and visits has been running outside the framework of the rule of law since its emergence, and the system design of the system of letters and visits, which has a strong color of rule of man, has produced great contradictions and conflicts with the concept of the rule of law. Therefore, it is necessary to reflect and reconstruct the petition system. This paper takes the basic theory of petition system as the starting point, discusses the connotation, function and foundation of the petition system, and then discusses the present situation of the petition system from the two aspects of legislation and operation. Then in the context of the rule of law to reflect on the system of letters and visits, to its rationality and the plight of the full argument and in-depth analysis, and finally under the context of the rule of law to reconstruct the system of letters and visits, to carry out theoretical thinking. Function orientation and specific reconstruction of rule of law are put forward.
