【摘要】：黨的十八屆四中全會(huì)通過了《中共中央關(guān)于全面推進(jìn)依法治國(guó)若干重大問題的決定》,提出全面推進(jìn)依法治國(guó)重大戰(zhàn)略。全面推進(jìn)依法治國(guó),是以習(xí)近平同志為核心的黨中央?yún)f(xié)調(diào)推進(jìn)“四個(gè)全面”治國(guó)理政戰(zhàn)略思想的重要組成部分。全面推進(jìn)依法治國(guó)要求“科學(xué)立法、嚴(yán)格執(zhí)法、公正司法、全民守法”,將中國(guó)法治建設(shè)推向新高度。大學(xué)生作為國(guó)家精英、社會(huì)棟梁,在推進(jìn)全面依法治國(guó)的歷史進(jìn)程中擔(dān)當(dāng)著重要的歷史使命。在全面依法治國(guó)背景下,準(zhǔn)確評(píng)判我國(guó)大學(xué)生法制教育的現(xiàn)狀,分析法制教育取得的成績(jī)、存在的不足,研究全面依法治國(guó)戰(zhàn)略提出對(duì)大學(xué)生法制教育的新機(jī)遇、新挑戰(zhàn),并提出全面推進(jìn)依法治國(guó)背景下改進(jìn)大學(xué)生法制教育的策略、方式、方法,對(duì)提高大學(xué)生法制教育實(shí)效具有重要的理論意義和深遠(yuǎn)的現(xiàn)實(shí)意義。論文分五個(gè)部分:第一部分是緒論,闡明了選題背景和研究意義,對(duì)國(guó)內(nèi)外相關(guān)研究進(jìn)行了綜述,提出了本文的研究思路、研究方法、創(chuàng)新點(diǎn)和存在的不足。第二部分是概念界定和本文研究的理論基礎(chǔ)。本文涉及到的基本概念包括“全面依法治國(guó)”、“法制”、“法治”、“大學(xué)生法制教育”等�！榜R克思主義的法制教育理論”、“人的自我需求理論”、“以人為本理論”等為本文研究奠定了理論基礎(chǔ)。第三部分回顧了改革開放以來我國(guó)大學(xué)生法制教育的歷程和取得的成就,分析了全面依法治國(guó)戰(zhàn)略提出后對(duì)大學(xué)生法制教育提出的新的價(jià)值導(dǎo)向。改革開放以來,我國(guó)大學(xué)生法制教育從無到有,從零散到系統(tǒng)取得了舉國(guó)公認(rèn)的成就,為建設(shè)法治中國(guó)起到了重要作用。但是推進(jìn)全面依法治國(guó)戰(zhàn)略又為高校法制教育提出了全新的要求,大學(xué)生對(duì)法制教育的訴求更加迫切,社會(huì)應(yīng)更加注重對(duì)大學(xué)生法制教育的權(quán)威塑造。第四部分論述了全面依法治國(guó)背景下大學(xué)生法制教育面臨的新挑戰(zhàn)。目前我國(guó)社會(huì)環(huán)境還不能完全適應(yīng)全面依法治國(guó)背景下大學(xué)生法制教育的新形勢(shì);高校法制教育現(xiàn)狀還不能完全滿足全面依法治國(guó)的新要求;大學(xué)生的法制素養(yǎng)、法律知識(shí)、法制思維、守法用法能力及法制行為方式等與全面推進(jìn)依法治國(guó)還存在一定差距。這些挑戰(zhàn)來自于社會(huì)、學(xué)校和大學(xué)生自身。第五部分提出了全面依法治國(guó)背景下完善大學(xué)生法制教育的對(duì)策建議。對(duì)照全面依法治國(guó)的新要求,立足當(dāng)前大學(xué)生法制教育整體現(xiàn)狀,從社會(huì)、高校及大學(xué)生自身提出了優(yōu)化和改進(jìn)大學(xué)生法制教育的途徑、方式、方法、策略,以及提高大學(xué)生法制教育實(shí)效性的幾點(diǎn)建議。
[Abstract]:The fourth Plenary session of the 18th CPC Central Committee adopted the "decision of the CPC Central Committee on comprehensively promoting governing the country according to Law," and put forward a major strategy for comprehensively promoting the rule of law. To advance the rule of law in an all-round way is an important part of the Party Central Committee, which regards Comrade Xi Jinping as the core. To advance the rule of law in an all-round way requires "scientific legislation, strict law enforcement, fair administration of justice, and law-abiding by the whole people", which will push the construction of China's rule of law to a new height. As the elite of the country and the pillars of the society, college students are playing an important historical mission in the historical process of promoting the rule of law in an all-round way. Under the background of ruling the country according to law, the present situation of the legal education of college students in our country is judged accurately, the achievements and shortcomings of the legal education are analyzed, and the new opportunities and challenges for the legal education of college students are put forward by studying the strategy of governing the country according to the law in an all-round way. It also puts forward the strategies, ways and methods of improving the legal education of college students under the background of governing the country according to law, which has important theoretical and far-reaching practical significance for improving the effectiveness of the legal education of college students. The paper is divided into five parts: the first part is the introduction, which clarifies the background and significance of the topic, summarizes the related research at home and abroad, and puts forward the research ideas, research methods, innovation points and shortcomings of this paper. The second part is the definition of the concept and the theoretical basis of this study. The basic concepts involved in this paper include "overall rule of law", "legal system", "rule of law", "college students' legal education" and so on. The Marxist theory of legal education, the theory of human self-demand and the theory of people-oriented have laid a theoretical foundation for the study of this paper. The third part reviews the history and achievements of the legal education of college students since the reform and opening up, and analyzes the new value orientation for the legal education of college students after the overall strategy of governing the country according to law is put forward. Since the reform and opening up, the legal education of college students in our country has made the universally recognized achievements from scratch, from scattered to systematic, and has played an important role in the construction of China under the rule of law. However, the promotion of comprehensive rule of law strategy has put forward a new requirement for the legal education in colleges and universities. The demands of college students for legal education are more urgent, and the society should pay more attention to shaping the authority of the legal education of college students. The fourth part discusses the new challenges facing the legal education of college students under the background of governing the country according to law. At present, the social environment of our country cannot fully adapt to the new situation of legal education for college students under the background of comprehensive rule of law; the present situation of legal education in colleges and universities cannot fully meet the new requirements of governing the country according to law; the legal literacy and legal knowledge of college students, There is still a certain gap between legal thinking, law-abiding ability and legal behavior. These challenges come from society, schools and college students themselves. The fifth part puts forward the countermeasures and suggestions to perfect the legal education of college students under the background of ruling the country according to law. According to the new requirements of ruling the country according to the law, based on the present situation of the legal education of college students, this paper puts forward the ways, methods, strategies to optimize and improve the legal education of college students from the society, universities and college students themselves. Some suggestions on how to improve the effectiveness of legal education for college students are also given.
