【摘要】：戶籍制度是指與戶籍或者戶口相關(guān)的一整套政治、經(jīng)濟(jì)和法律制度,其職能包括個(gè)人身份證明、資源和財(cái)富配置。我國嚴(yán)格的城鄉(xiāng)分割二元戶籍制度是計(jì)劃經(jīng)濟(jì)時(shí)代的產(chǎn)物,在近半個(gè)多世紀(jì)里,二元戶籍制度逐漸發(fā)展完備,但隨著經(jīng)濟(jì)進(jìn)步,附加在二元戶籍管理制度之上的額外的社會(huì)功能過多,人為地進(jìn)行了“階級(jí)劃分”,漏洞百出的二元戶籍制度已經(jīng)被公認(rèn)為是我國城市化進(jìn)程的最大障礙。在流動(dòng)人口激增的今天,陳舊的二元戶籍管理制度也限制了人口的自由遷徙,流動(dòng)人員的子女無法完全享有平等的教育,再加上城鄉(xiāng)教育資源不平衡,高考同分不同錄現(xiàn)象普遍存在。自由遷徙權(quán)是重要的人身自由權(quán)之一,是現(xiàn)代法治國家公民的一項(xiàng)基本人權(quán),同時(shí)也是近代民主憲政條件下的公民的一項(xiàng)重要憲法權(quán)力。公民不應(yīng)該為了實(shí)現(xiàn)自由遷徙而失去任何其他權(quán)力,包括接受平等教育的權(quán)力,但事實(shí)上,陳舊的二元戶籍制度已經(jīng)嚴(yán)重影響到我國的教育公平。本文首先從分析我國戶籍制度的理論依據(jù)入手,解釋了戶口利益的概念和分類,分析了戶口利益的差異所造成的城鄉(xiāng)政治、經(jīng)濟(jì)、社會(huì)的不平等；其次,從歷史變遷的角度,筆者分析了戶籍制度的形成時(shí)期、鞏固時(shí)期、過渡時(shí)期和變革時(shí)期,分別介紹了每個(gè)時(shí)期的特點(diǎn)與互動(dòng)狀態(tài)；再次,分析了當(dāng)前戶籍制度下教育資源分配的不均衡造成的教育不公平以及人口流動(dòng)障礙造成的教育不公平。最后,筆者梳理了武漢市戶籍制度改革的歷程,并針對(duì)武漢市戶籍制度改革中存在的歧視性教育壁壘、社會(huì)利益分配不均以及制度設(shè)計(jì)與教育資源供給錯(cuò)位等問題,提出要通過減少條件性準(zhǔn)入戶籍壁壘,建立以居住地為基礎(chǔ)的戶口登記制度,提供多元的教育資源等方式,力求緩解戶籍制度造成的教育不公平現(xiàn)象。
[Abstract]:Household registration system refers to a whole set of political, economic and legal systems related to household registration or household registration. Its functions include personal identification, resources and wealth allocation. China's strict urban-rural division of the dual household registration system is the product of the planned economy era, in the last half century, the dual household registration system gradually developed, but with the economic progress, The extra social functions attached to the dual household registration management system are excessive, and the "class division" is carried out artificially. The flawed dual household registration system has been recognized as the biggest obstacle to the process of urbanization in China. At a time when the floating population is surging, the old dual household registration management system has also restricted the free movement of the population, and the children of the floating population cannot fully enjoy equal education, coupled with the imbalance between urban and rural education resources. The phenomenon of the same score and different record in the college entrance examination is widespread. The right to freedom of movement is one of the important rights of personal liberty, a basic human right of citizens in modern countries ruled by law, and also an important constitutional power of citizens under the conditions of modern democratic constitutionalism. Citizens should not lose any other rights in order to realize freedom of movement, including the right to receive equal education, but in fact, the old dual household registration system has seriously affected the educational fairness of our country. This paper begins with the theoretical basis of the household registration system in China, explains the concept and classification of household registration interests, analyzes the political, economic and social inequalities between urban and rural areas caused by the differences in household registration interests, and secondly, from the perspective of historical changes. The author analyzes the forming period of household registration system, the period of consolidation, the period of transition and the period of change, and introduces the characteristics and interactive state of each period respectively. This paper analyzes the educational unfairness caused by the imbalance in the distribution of educational resources under the current household registration system and the educational unfairness caused by the obstacle of population mobility. Finally, the author combs the history of the reform of the household registration system in Wuhan, and aims at the discriminatory educational barriers, the uneven distribution of social benefits and the mismatch between the system design and the supply of educational resources in the reform of the household registration system in Wuhan. In order to alleviate the educational injustice caused by the household registration system, we should reduce the barriers of conditional entry to household registration, establish a residence registration system based on residence, and provide multiple educational resources.
