【摘要】：村民委員會(huì)換屆選舉是我國農(nóng)村政治生活的一件大事。自村民委員會(huì)選舉制度開始實(shí)施以來,河北省村民委員會(huì)已歷經(jīng)十次換屆,選舉程序在不斷規(guī)范,選舉制度在不斷完善,可以說,河北省農(nóng)村基層民主建設(shè)取得了顯著成績。然而,隨著村民民主法制意識(shí)的不斷增強(qiáng),村民委員會(huì)選舉實(shí)踐發(fā)生了深刻變化。由于河北省村民委員會(huì)選舉制度存在的問題、缺陷導(dǎo)致選舉產(chǎn)生的各種矛盾和問題越來越突出,這在很大程度上損害了廣大村民的基本民主權(quán)利,影響了農(nóng)村社會(huì)穩(wěn)定大局,不利于村民自治健康有序發(fā)展。村民委員會(huì)選舉制度是依據(jù)憲法和有關(guān)法律制定的關(guān)于農(nóng)村民主選舉的組織和行為上的法律法規(guī)、政策和規(guī)范性文件等。本文所研究的“河北省村民委員會(huì)選舉制度”,不僅包括《河北省村民委員會(huì)選舉辦法》等法律法規(guī),還包括河北省各級(jí)黨委政府制定的指導(dǎo)換屆工作的規(guī)范性文件、政策要求以及貫穿整個(gè)選舉工作的體制機(jī)制。保定市村民委員會(huì)換屆選舉工作是在河北省統(tǒng)一安排部署和總體要求下進(jìn)行的,可以說,保定市村民委員會(huì)選舉出現(xiàn)的各種情況和問題是河北省的一個(gè)縮影。而選舉中各種問題的出現(xiàn),正是由于選舉制度還存在很多缺陷和不足。通過分析在選舉中出現(xiàn)的情況和問題,才能找到完善制度的對(duì)策。本文主要以保定市第十屆村委會(huì)換屆選舉為研究重點(diǎn),通過對(duì)選舉全過程的觀察、走訪、調(diào)研和思考,梳理總結(jié)了保定市第十屆村委會(huì)選舉的基本情況以及存在的問題,系統(tǒng)分析了影響村委會(huì)選舉的主要因素,提出了完善河北省村民委員會(huì)選舉制度的對(duì)策:一是加強(qiáng)對(duì)村民的宣傳教育;二是進(jìn)一步健全村民委員會(huì)選舉程序和法律制度;三是建立村民委員會(huì)選舉的長效機(jī)制,希望能對(duì)河北省農(nóng)村基層民主選舉工作有所裨益。
[Abstract]:The villagers'committee election is a major event in our country's rural political life. Since the implementation of the villagers' committee election system, the villagers' committee in Hebei Province has undergone ten changes, the election procedure has been constantly standardized, and the electoral system has been continuously improved. It can be said that the rural grass-roots democratic construction in Hebei Province has made remarkable achievements. However, with the strengthening of villagers' consciousness of democracy and legal system, the practice of villagers' committee election has undergone profound changes. As a result of the problems existing in the election system of villagers' committees in Hebei Province, the defects have led to more and more prominent contradictions and problems of election, which to a large extent have damaged the basic democratic rights of the villagers and affected the overall situation of social stability in rural areas. It is not conducive to the healthy and orderly development of villagers' autonomy. The election system of villagers' committee is a kind of laws, regulations, policies and normative documents about the organization and behavior of rural democratic election according to the constitution and relevant laws. The "election system of villagers' committees in Hebei Province" studied in this paper includes not only the laws and regulations such as the methods for electing villagers' Committees in Hebei Province, but also the normative documents formulated by the Party committees and governments at all levels in Hebei Province to guide the work of the transition. Policy requirements and institutional mechanisms that permeate the entire electoral process. The election of the villagers' committee in Baoding City was carried out under the unified arrangement and overall requirements of Hebei Province. It can be said that the various situations and problems in the election of the villagers' committee in Baoding City are a microcosm of Hebei Province. The emergence of various problems in the election, precisely because of the electoral system there are still many defects and deficiencies. By analyzing the situation and problems in the election, we can find the countermeasure to perfect the system. This article mainly takes the 10th village committee election of Baoding as the research focus, through observing, visiting, investigating and thinking about the whole process of election, combing and summing up the basic situation and existing problems of the 10th village committee election in Baoding. This paper systematically analyzes the main factors that affect the election of village committee, and puts forward some countermeasures to perfect the election system of village committee in Hebei province: first, to strengthen the propaganda and education of villagers; second, to further improve the election procedure and legal system of village committee; The third is to establish the long-term mechanism of villagers' committee election, hoping to benefit the rural grassroots democratic election in Hebei province.
