【摘要】：2016年11月7日上午,十二屆全國人大常委會第二十四次會議表決,正式通過了《中華人民共和國網(wǎng)絡安全法》,將于2017年6月1日起施行。該法進一步界定了關鍵信息基礎設施范圍,對攻擊、破壞我國關鍵信息基礎設施的境外組織和個人規(guī)定了相應的懲治措施,增加了懲治網(wǎng)絡詐騙等新型網(wǎng)絡違法犯罪活動的規(guī)定等。2016年12月27日,《國家網(wǎng)絡空間安全戰(zhàn)略》發(fā)布,作為我國首次發(fā)布的關于網(wǎng)絡空間安全的戰(zhàn)略性綱要文件,該戰(zhàn)略不僅闡明了中國關于網(wǎng)絡空間發(fā)展和安全的重大立場和主張,更明確了若干年內(nèi)的戰(zhàn)略方針和主要任務,可概括為"堅定捍衛(wèi)網(wǎng)絡空間主權、堅決維護國家安全、保護關鍵信息基礎設施、加強網(wǎng)絡文化建設、打擊網(wǎng)絡恐怖和違法犯罪、完善網(wǎng)絡治理體系、夯實網(wǎng)絡安全基礎、提升網(wǎng)絡空間防護能力、強化網(wǎng)絡空間國際合作"等九個方面。"一法一戰(zhàn)略"相輔相成,從法律層面保障我國網(wǎng)絡空間安全,促進我國從網(wǎng)絡大國到網(wǎng)絡強國的演變,在全球網(wǎng)絡空間治理中發(fā)揮中國的積極作用。特邀相關專家學者,從不同角度就《網(wǎng)絡安全法》和《國家網(wǎng)絡空間安全戰(zhàn)略》的發(fā)布做解讀。
[Abstract]:On the morning of November 7, 2016, the 24th meeting of the standing Committee of the Twelfth National people's Congress voted to formally adopt the Law of the people's Republic of China on Cybersecurity, which will come into effect on June 1, 2017. The law further defines the scope of the critical information infrastructure and provides appropriate penalties for foreign organizations and individuals who attack and destroy the key information infrastructure in China. The provisions on punishing new types of cyber illegal and criminal activities, such as cyber fraud, were added. On December 27, 2016, the National Cyberspace Security Strategy was issued as the first strategic outline document on cyberspace security in China. The strategy not only clarifies China's major position and stand on the development and security of cyberspace, but also clarifies the strategic guidelines and main tasks for a number of years, which can be summarized as "firmly safeguarding the sovereignty of cyberspace and resolutely safeguarding national security". To protect key information infrastructure, to strengthen the construction of network culture, to crack down on cyberterror and crimes, to improve the network governance system, to consolidate the foundation of network security, and to enhance the ability of cyberspace protection. Strengthen international cooperation in cyberspace "and other nine aspects." "one law and one strategy" complement each other, safeguard our country's cyberspace security from the legal level, promote the evolution of our country from the network big country to the network powerful country, and play a positive role in the global cyberspace governance. Specially invited experts and scholars from different angles to interpret the release of the Cybersecurity Law and the National Cyberspace Security Strategy.
