正當(dāng)程序視角下政府管理大學(xué)的法治化研究

【摘要】: 隨著社會的不斷發(fā)展,大學(xué)在社會中的地位和作用逐步增強,如何進一步理順政府與大學(xué)的關(guān)系,完善政府對大學(xué)的管理,成為當(dāng)代教育界需要面對和研究的重要課題。在英美法系國家,其法律制度相當(dāng)完善,在管理大學(xué)的過程中政府主要通過程序正當(dāng)和實體合法來保障大學(xué)的自治地位,而我國屬于大陸法系,重實體輕程序的傳統(tǒng)觀念一直在法律界存在,政府與大學(xué)的關(guān)系很大程度還是行政間的隸屬關(guān)系,政府對大學(xué)的管理主要還是通過實體法來進行管理,忽略了對程序正當(dāng)性的考慮。 本文認為,在提倡依法治教的今天,不僅要從法律制度上尊重和保障大學(xué)的辦學(xué)自主權(quán),同時也要從程序上給予保障,正當(dāng)程序理念下要求政府明確行使權(quán)力的規(guī)范。因此,本文的創(chuàng)新之處就在于將正當(dāng)程序的理念引入到政府對大學(xué)的管理中,從而嘗試從程序上構(gòu)建政府管理大學(xué)的法治化模型:在教育決策的過程中,政府不是決策制定的唯一主體,而應(yīng)提倡民主參與程序,讓大學(xué)校長、教師等共同參與到?jīng)Q策過程;在政府管理大學(xué)的執(zhí)行程序中,政府應(yīng)按照信息公開的原則主動向相關(guān)人公開信息;在政府管理大學(xué)的監(jiān)督程序中,通過上級政府、司法機關(guān)和新聞監(jiān)督來共同規(guī)范政府的管理行為;在大學(xué)的法律救濟中,通過教育的申訴、復(fù)議機制以及教育的仲裁與調(diào)節(jié)來維護大學(xué)的自身權(quán)利。 第一章從理論上論證正當(dāng)程序和政府管理大學(xué)的邏輯契合,奠定全文的理論基點和研究基調(diào)。首先,介紹正當(dāng)程序的制度淵源,正當(dāng)程序最早產(chǎn)生于英國,后傳入美國并載入美國憲法,19世紀末才開始傳入大陸法系。其次,介紹我國政府管理大學(xué)的法制歷程。新中國成立后,政府對大學(xué)的管理由無法到有法、最后到多部法律,但這些法律自身存在矛盾、并且與行政法、行政訴訟法等其他法律不兼容,更為嚴重的是教育法律的滯后性,遠遠跟不上社會的發(fā)展。最后,由上述原因,從邏輯上論證正當(dāng)程序在政府管理大學(xué)的必要性。因為正當(dāng)程序能夠?qū)崿F(xiàn)公正、公平,體現(xiàn)正義,并且正當(dāng)程序也能夠限制恣意、防止權(quán)力濫用并實現(xiàn)民主參與。 第二章從現(xiàn)實角度入手。首先介紹在我國近期出現(xiàn)的政府管理大學(xué)中出現(xiàn)的爭議性案件,如2008年4月西北政法大學(xué)因質(zhì)疑陜西省學(xué)位辦不公正對待其申報博士學(xué)位授權(quán)點申請,向陜西省人民政府提出行政復(fù)議案。其次分析我國政府在管理大學(xué)中違背正當(dāng)程序的原因。例如:有“重實體、輕程序”的傳統(tǒng)意識,有法規(guī)效力的參差不齊等。 第三章從制度上設(shè)計如何實現(xiàn)政府管理大學(xué)遵守正當(dāng)程序。文中從政府管理大學(xué)的決策程序、執(zhí)行程序、監(jiān)督程序三個方面進行闡述,最后介紹政府管理大學(xué)的救濟程序,即當(dāng)政府管理大學(xué)中出現(xiàn)問題,侵害到了大學(xué)的權(quán)利時,大學(xué)如何通過法律去維護自身的權(quán)利。
[Abstract]:With the continuous development of society, the status and role of universities in the society is gradually enhanced. How to further straighten out the relationship between the government and the university and improve the management of universities by the government has become an important subject to be faced and studied by the contemporary educational circles.In Anglo-American law countries, its legal system is quite perfect. In the process of managing universities, the government mainly guarantees the autonomous status of universities through due process and legal entity, while our country belongs to the continental law system.The traditional concept of valuing substance over procedure has always existed in the legal profession. The relationship between the government and the university is to a large extent the subordinate relationship between the administration and the university. The administration of the university by the government is mainly managed by the substantive law.The consideration of the legitimacy of the procedure is ignored.This paper holds that today, when we advocate governing education according to law, we should not only respect and guarantee the autonomy of running a university from the legal system, but also guarantee it from a procedural point of view. Under the concept of due process, the government is required to clearly exercise its power.Therefore, the innovation of this paper lies in the introduction of the concept of due process into the administration of universities by the government, so as to try to construct a legal model of government management of universities from a procedural point of view: in the process of educational decision-making,The government is not the only main body of decision-making, but should promote democratic participation procedure, involving university presidents and teachers in the decision-making process.The government should take the initiative to disclose the information to the relevant persons in accordance with the principle of information disclosure; in the supervisory procedure of the government managing the university, the government should jointly regulate the government's management behavior through the superior government, the judicial organ and the news supervision; in the legal relief of the university, the government should take the initiative to disclose the information to the relevant persons;To protect the university's own rights through educational appeal, reconsideration mechanism and educational arbitration and regulation.The first chapter theoretically demonstrates the logical agreement between due process and government management universities, and establishes the theoretical basis and research tone of the full text.First of all, it introduces the system origin of due process, which originated in England, and was introduced into the United States and the United States Constitution in the late 19th century before it began to be introduced into the civil law system.Secondly, it introduces the legal history of our government management universities.After the founding of the people's Republic of China, the administration of universities by the government has changed from being unable to have laws, and finally to many laws. However, these laws have their own contradictions and are incompatible with other laws such as administrative law, administrative procedure law, etc.What is more serious is the lagged nature of educational law, far from keeping up with the development of society.Finally, from the above reasons, the necessity of due process in government management universities is demonstrated logically.Because due process can achieve justice, fairness, justice, and due process can limit arbitrariness, prevent abuse of power and achieve democratic participation.The second chapter starts from the realistic angle.First of all, it introduces the controversial cases in the recent government management universities in China. For example, in April 2008, the Northwest University of political Science and Law, because of questioning the unfair treatment of the Shaanxi Provincial Scholarship Office, applied for a doctorate application.To the Shaanxi Provincial people's Government for administrative review.Secondly, it analyzes the reasons why our government violates due process in the management of universities.For example: there is a "emphasis on substance, light process" of the traditional consciousness, there are varying laws and regulations, and so on.The third chapter designs how to realize the government management university obeys the due process from the system.This paper expounds the decision-making procedure, executive procedure and supervision procedure of government management university. At last, it introduces the relief procedure of government management university, that is, when there is a problem in government management university, it infringes the right of university.How universities protect their rights by law.
