【摘要】：體育組織應(yīng)在法治視域下設(shè)定處罰規(guī)則。體育處罰規(guī)則內(nèi)生于體育的游戲競(jìng)技性,其又以行業(yè)自治為前提。從法治化考慮,體育組織設(shè)定處罰規(guī)則時(shí)應(yīng)尊重法律設(shè)定的法律保留原則,不得超越憲法和法律之上進(jìn)行"立法",在權(quán)利讓渡的邊界上,不得對(duì)人身權(quán)設(shè)定體育處罰規(guī)則,其設(shè)定的處罰規(guī)則的效力對(duì)象以體育組織內(nèi)成員為界。從設(shè)定的合理化考慮,體育處罰規(guī)則的設(shè)定要注意它的功能性、專業(yè)化和正當(dāng)性問題。在功能化方面要準(zhǔn)確把握它設(shè)定的"度"問題,既不能設(shè)定得過于嚴(yán)格,也不能過于疲軟。在專業(yè)化方面,應(yīng)貼合體育的專業(yè)特性來設(shè)定,以增強(qiáng)處罰的有效性。在正當(dāng)化方面,其設(shè)定對(duì)內(nèi)要建立在組織成員的合意或同意認(rèn)可基礎(chǔ)之上,對(duì)外要建立在法治正當(dāng)化基礎(chǔ)之上。按照章程規(guī)定進(jìn)行"自主性立法"是理解體育罰則設(shè)定的正當(dāng)化前提,進(jìn)而在正當(dāng)程序化方面,應(yīng)盡可能地在程序設(shè)置上能保證所有成員平等地參與到處罰規(guī)則的制定中來。在處罰規(guī)則各類設(shè)定的正當(dāng)化方面,一是正確理解體育罰則設(shè)定的"自主性立法"性質(zhì),二是不得對(duì)人身罰進(jìn)行設(shè)定,三是應(yīng)根據(jù)體育的專業(yè)特性來設(shè)定聲譽(yù)罰、行為罰和財(cái)產(chǎn)罰。
[Abstract]:Sports organizations should set punishment rules from the perspective of rule of law.The rules of sports punishment are born in the game competition of sports, and its premise is industry autonomy.Considering the rule of law, sports organizations should respect the principle of legal reservation set by law when setting punishment rules, and should not "legislate" beyond the Constitution and the law, and should not set up sports punishment rules on personal rights on the boundary of the transfer of rights.The effective object of the penalty rules set by it is the members of the sports organization.Considering the rationalization of setting, the rules of sports punishment should pay attention to its function, specialization and legitimacy.In the aspect of functionalization, we should grasp precisely the "degree" problem that it sets, neither too strict nor too weak.In the aspect of specialization, it should be set up in accordance with the professional characteristics of sports in order to enhance the effectiveness of punishment.In the aspect of legitimacy, its establishment should be based on the consensus or approval of the members of the organization, and on the legitimacy of the rule of law.According to the articles of association, "independent legislation" is the premise to understand the legitimacy of the setting of sports penalty, and in the aspect of proper procedure, all members should be guaranteed to participate equally in the formulation of punishment rules.In terms of the justification of all kinds of penalty rules, one is to correctly understand the nature of "autonomous legislation" set by sports punishment, the other is not to set up personal punishment, and the third is to establish reputation punishment according to the professional characteristics of sports.Behavior penalty and property penalty.
