大學生就業(yè)問題分析與法治路徑選擇

【摘要】:就業(yè)是民生之本。隨著我國社會政治、經(jīng)濟、文化的變革,大學生的就業(yè)形勢日益嚴峻,已成為目前社會的熱點話題。首先,大學生作為我國青年儲備人才的重要組成部分,肩負著科教興國和振興中華的光榮使命。大學生就業(yè)不僅直接關(guān)系到百姓的切身利益和千萬個家庭的幸福,還直接影響著社會的和諧與穩(wěn)定。其次,大學生就業(yè)不僅反映了當前我國高等教育的辦學水平和質(zhì)量,在一定程度上影響著高等教育大眾化的進展。但是,在大學生就業(yè)過程中,由于我國就業(yè)市場的法規(guī)和政策欠完善,各種侵害勞動權(quán)益的案件時有發(fā)生。雖然我國已經(jīng)出臺了《勞動法》、《勞動合同法》、《就業(yè)促進法》等保護勞動者合法權(quán)益的法律法規(guī),很大程度上體現(xiàn)了保護勞動者合法權(quán)益的立法精神,但對大學生就業(yè)中的法律保護依然不足。主要體現(xiàn)于《勞動合同法》所包含的主體不夠全面,勞動爭議解決程序過于復雜,對勞動者實行解雇理由不夠具體;《就業(yè)促進法》對大學生就業(yè)權(quán)益方面的保護缺乏可操作性。另外,就業(yè)市場執(zhí)法機構(gòu)設置欠缺、法律監(jiān)督不到位、執(zhí)法不公、救濟程序效率低、勞動爭議受案范圍狹窄、訴訟成本過高等。鑒于此,加強對大學生就業(yè)中的法治路徑研究和探討是非常必要的。 全文共分四個部分: 第一部分是導論。主要從問題的提出介紹研究的目的和意義,國內(nèi)外研究現(xiàn)狀、研究的思路和方法。 第二部分大學生就業(yè)相關(guān)理論概述 第三部分針對我國大學生就業(yè)現(xiàn)狀及成因,從法律視角結(jié)合案例及理論分析的方法進行了研究和論述,為大學生就業(yè)決策提供依據(jù)。 第四部分論證了大學生就業(yè)必須提升法治路徑。加快建立大學生就業(yè)的立法進程,提高在校大學生和畢業(yè)生守法意識,保障大學生創(chuàng)業(yè)促就業(yè)的合法權(quán)益不受到侵犯,用法律調(diào)整規(guī)范涉及人民群眾的最根本、最直接、最現(xiàn)實的利益問題是解決大學生就業(yè)的根本問題,也是民生得到長久保障的必然選擇。
[Abstract]:Employment is the foundation of people's livelihood.With the change of social politics, economy and culture, the employment situation of college students has become a hot topic.First of all, college students, as an important part of China's youth reserve, shoulder the glorious mission of rejuvenating the country through science and education.The employment of college students is not only directly related to the vital interests of the common people and the happiness of thousands of families, but also directly affects the harmony and stability of the society.Secondly, the employment of college students not only reflects the current level and quality of higher education in China, but also affects the progress of popularization of higher education to a certain extent.However, in the process of college students' employment, due to the imperfect laws and policies of our country's employment market, various cases of infringing labor rights and interests occur from time to time.Although China has issued laws and regulations to protect the legitimate rights and interests of workers, such as the Labor Law, the Labor contract Law and the Employment Promotion Law, to a large extent, it embodies the legislative spirit of protecting the legitimate rights and interests of workers.However, the legal protection of college students in employment is still inadequate.The main body contained in the Labor contract Law is not comprehensive, the labor dispute settlement procedure is too complex, the reasons for dismissal of workers are not specific enough, and the Employment Promotion Law lacks maneuverability to protect the employment rights and interests of college students.In addition, the employment market law enforcement agencies are not set up, the legal supervision is not in place, the administration of justice is unfair, the efficiency of the relief procedure is low, the scope of accepting cases of labor disputes is narrow, the cost of litigation is too high, and so on.In view of this, it is very necessary to strengthen the research and discussion on the path of rule of law in the employment of college students.The full text is divided into four parts:The first part is an introduction.This paper introduces the purpose and significance of the research, the present situation of the research at home and abroad, the ideas and methods of the research.The second part: a brief introduction to the Theory of College students'EmploymentThe third part aims at the present situation and causes of college students' employment in our country, from the legal angle of view combined with cases and theoretical analysis of the method of research and discussion, for college students to provide a basis for employment decision-making.The fourth part demonstrates that the employment of college students must improve the path of rule of law.To speed up the legislative process of establishing the employment of college students, to raise the awareness of college students and graduates to abide by the law, to ensure that the legitimate rights and interests of college students in undertaking businesses and promoting employment are not infringed upon, and to regulate by law the most fundamental and direct issues involving the masses of the people.The most realistic interest problem is to solve the fundamental problem of employment of college students, and it is also the inevitable choice to ensure the livelihood of the people for a long time.
