中、美、日及中國臺(tái)灣地區(qū)的幼兒園體育法制建設(shè)之比較研究

【摘要】:近年來,黨和國家一貫重視教育法制的建設(shè)。2007年5月,國務(wù)院頒布實(shí)施的《國家教育事業(yè)發(fā)展“十一五”規(guī)劃綱要》中明確提出“要適時(shí)啟動(dòng)學(xué)前教育法的起草工作”。同年11月,國家教育部又將學(xué)前教育立法列為今后五年的立法工作重點(diǎn),并明確列入2008年的工作要點(diǎn)。2010年7月29日,《國家中長期教育改革和發(fā)展規(guī)劃綱要(2010—2020年)》中將學(xué)前教育放在了發(fā)展任務(wù)的首位?v觀世界各國,學(xué)前教育法制建設(shè)的發(fā)展是一個(gè)不可阻擋的國際趨勢(shì)。歐美國家紛紛通過立法來保障和促進(jìn)本國學(xué)前教育的發(fā)展。 體育是幼兒園教育中的重要構(gòu)成,但我國的學(xué)前教育立法中體育相關(guān)法律法規(guī)卻非常少。歐美發(fā)達(dá)國家的學(xué)前立法雖然相對(duì)完善,但其中關(guān)于體育的法律法規(guī)也不盡完善。因此,相對(duì)其他國民教育立法和體育立法而言,我國的幼兒園體育法制建設(shè)需要加強(qiáng),也是近期學(xué)前教育立法需要重點(diǎn)關(guān)注的問題。 本文從實(shí)際出發(fā),通過文獻(xiàn)資料法、專家訪談法和比較分析法,對(duì)我國當(dāng)前幼兒園體育法制建設(shè)進(jìn)行研究,從學(xué)前教育立法、幼兒體育權(quán)利、幼兒教師資格認(rèn)定、幼兒園體育課程建設(shè)等方面,比較分析當(dāng)前國際上學(xué)前法制較為先進(jìn)的美國、日本等歐美國家和與我國大陸較為相近的中國臺(tái)灣地區(qū)。認(rèn)為我國大陸的幼兒園體育法制建設(shè)需要加強(qiáng),學(xué)前教育立法需要和整個(gè)國民教育立法相配套,并加快我國幼兒園立法。從法制法規(guī)層面,保障幼兒的體育權(quán)、規(guī)范我國幼兒園教師資格認(rèn)定中的體育專業(yè)性要求、補(bǔ)充完善幼兒園體育意外傷害相關(guān)的法律法規(guī)、加快建設(shè)幼兒園體育課程,完善我國的國民教育的法制化建設(shè),加快我國依法治國的建設(shè)步伐。
[Abstract]:In recent years, the Party and the state have always attached importance to the construction of the educational legal system. In May 2007, the State Council promulgated and implemented the outline of the Eleventh Five-Year Plan for the Development of the National Education cause, which clearly proposed that "the drafting of the Law on Preschool Education should be started in good time".In November of the same year, the Ministry of Education made the legislation on preschool education the focus of its legislative work in the next five years.On July 29, 2010, the outline of the National Medium-and Long-Term Education Reform and Development Plan 2010-2020 put preschool education in the first place of the development task.Throughout the world, the legal construction of preschool education is an irresistible international trend.European and American countries have adopted legislation to protect and promote the development of their preschool education.Physical education is an important component of kindergarten education, but there are very few laws and regulations related to physical education in preschool education legislation in our country.Although the pre-school legislation of developed countries in Europe and America is relatively perfect, the laws and regulations on sports are not perfect.Therefore, compared with other national education legislation and sports legislation, the legal construction of kindergarten sports in China needs to be strengthened, and it is also a key issue that needs to be paid attention to in the recent pre-school education legislation.Based on the actual situation, through the methods of literature, expert interview and comparative analysis, this paper makes a study on the legal construction of kindergarten sports in our country, including the legislation of preschool education, the rights of children's sports, and the qualification of preschool teachers.From the aspects of kindergarten physical education curriculum construction, this paper compares and analyzes the current international legal system before school, such as the United States, Japan and other European and American countries, as well as China and Taiwan, which are close to the mainland of China.The author thinks that the legal construction of kindergarten sports in mainland China needs to be strengthened, the legislation of preschool education should be matched with the legislation of the whole nation's education, and the legislation of kindergarten should be accelerated.From the level of law and regulations, we should guarantee the children's sports rights, standardize the professional requirements of sports in the qualification of kindergarten teachers, complement and perfect the laws and regulations related to the accidental injury of kindergarten sports, and speed up the construction of the curriculum of kindergarten physical education.To perfect the legal construction of national education and speed up the construction of governing the country according to law.
