【摘要】：《中華人民共和國道路交通安全法》的頒布和實施,是我國道路交通法制建設歷程中的一座里程碑,掀開了我國道路交通安全管理事業(yè)全面走向法治時代的嶄新一頁,一定程度上改變了過去道路交通安全管理法制不健全、缺少必要的、高層次的法律依據的尷尬局面。交通安全管理相關法律法規(guī)制定以后,剩下的核心問題就在于如何落實和實施。正如美國社會法學家龐德所說：“法律的生命在于它的實行”①。因此,深入研究道路交通安全相關法律法規(guī)在實施過程中的具體問題,以便進一步推動交通安全管理法制建設,是一項具有現實意義的重要課題。 在闡述了加強道路交通安全執(zhí)法的重要意義的基礎上,文章指出了加強道路交通安全執(zhí)法是時代發(fā)展的內在要求、是保障民生的直接體現、是依法行政的重要內容、是社會和諧的切實保障。通過廣泛調查研究,本文對《中華人民共和國道路交通安全法》實施后取得的新成效進行了歸納,主要是：控制了道路交通安全事故的發(fā)生率、保護了交通參與人的合法權益、道路交通社會化管理有了新突破、提升了道路交通安全法治化水平、改善了交警的執(zhí)法形象。在總結加強道路交通安全執(zhí)法意義和分析新法取得的成效的基礎上,本文對我國道路交通安全法制建設中存在的問題給予了認真剖析,并指出現階段存在的問題主要表現為：多頭執(zhí)法現象嚴重、執(zhí)法難到位、權責定分不明、農村交通安全管理是軟肋、交警執(zhí)法困難多。 最后,本文從如何加強我省道路交通安全法制建設的角度出發(fā),從六個方面提出了對策：一是完善道路交通安全法律、法規(guī)相關條款；二是營造良好的道路交通環(huán)境；三是全面加強道路交通安全執(zhí)法；四是推進道路交通安全管理社會化；五是建設保障有力、盡職履責的公安交警隊伍；六是不斷提高公安交通執(zhí)法的科技水平。
[Abstract]:The promulgation and implementation of the Road Traffic Safety Law of the people's Republic of China is a milestone in the course of the legal construction of road traffic in China. To some extent, it has changed the awkward situation in the past that the legal system of road traffic safety management was not perfect and lacked the necessary and high-level legal basis. After the relevant laws and regulations of traffic safety management were formulated, The remaining core problem is how to implement and enforce. As the American social jurist pound put it, "the life of law lies in its implementation." 1. Therefore, to study in depth the specific problems in the implementation of laws and regulations related to road traffic safety. In order to further promote the construction of traffic safety management legal system, it is an important issue of practical significance. On the basis of expounding the important significance of strengthening the law enforcement of road traffic safety, the article points out that strengthening the law enforcement of road traffic safety is the inherent requirement of the development of the times, the direct embodiment of safeguarding the people's livelihood, and the important content of administration according to law. It is a practical guarantee of social harmony. Through extensive investigation and research, this paper sums up the new achievements made after the implementation of the Road Traffic Safety Law of the people's Republic of China, mainly as follows: the incidence of road traffic safety accidents is controlled, It has protected the legitimate rights and interests of traffic participants, made new breakthroughs in the socialized management of road traffic, and raised the level of legalization of road traffic safety. On the basis of summing up the significance of strengthening the law enforcement of road traffic safety and analyzing the effect of the new law, this paper makes a careful analysis of the problems existing in the legal construction of road traffic safety in our country. It is pointed out that the existing problems at this stage are as follows: the phenomenon of multi-head law enforcement is serious, the law enforcement is difficult, the power and responsibility are not clear, the rural traffic safety management is the weak point, and the traffic police have many difficulties in enforcing the law. Finally, from the point of view of how to strengthen the legal construction of road traffic safety in our province, this paper puts forward the countermeasures from six aspects: first, to perfect the relevant provisions of road traffic safety laws and regulations, secondly, to create a good road traffic environment; Third, to comprehensively strengthen the law enforcement of road traffic safety; fourth, to promote the socialization of road traffic safety management; fifth, to build a competent and responsible public security traffic police force; and sixth, to continuously improve the scientific and technological level of public security traffic law enforcement.
