【摘要】： 十六屆五中全會之后,社會主義新農(nóng)村建設(shè)的號角在中華大地全面吹響,擺脫“三農(nóng)”困境、再造山川秀美的新家園是新的時期我國農(nóng)村改革與發(fā)展的方向與目標(biāo)。新農(nóng)村建設(shè)需要全方位改造農(nóng)村社會諸多不和諧、不可持續(xù)發(fā)展,創(chuàng)建農(nóng)村社會主義新格局。在農(nóng)村的諸多不和諧、不可持續(xù)發(fā)展中,鄉(xiāng)鎮(zhèn)企業(yè)經(jīng)濟發(fā)展與環(huán)境保護(hù)的不和諧、不可持續(xù)發(fā)展尤為突出：隨著鄉(xiāng)鎮(zhèn)企業(yè)30年來的發(fā)展壯大,各種各樣的環(huán)境問題日益凸現(xiàn)。 在依法治國的今天,要建設(shè)生產(chǎn)發(fā)展、生活富裕、鄉(xiāng)風(fēng)文明、村容整潔、管理民主的社會主義新農(nóng)村,促進(jìn)人與自然的和諧發(fā)展,必須切實解決農(nóng)村工業(yè)發(fā)展帶來的環(huán)境困境,切實加強農(nóng)村生態(tài)與環(huán)境保護(hù),努力構(gòu)建包括立法、執(zhí)法、司法在內(nèi)的整套環(huán)境法律機制。 本文用五個部分的內(nèi)容闡釋了新農(nóng)村建設(shè)視野下鄉(xiāng)鎮(zhèn)企業(yè)環(huán)境法制建設(shè)問題： 緒論介紹了論文的研究背景與意義、文獻(xiàn)綜述和主要研究內(nèi)容。 第一章對我國鄉(xiāng)鎮(zhèn)企業(yè)環(huán)境問題作以全面綜述。在這一章,廓清了鄉(xiāng)鎮(zhèn)企業(yè)的概念,概括了鄉(xiāng)鎮(zhèn)企業(yè)發(fā)展取得的豐功偉績,重點表述了鄉(xiāng)鎮(zhèn)企業(yè)嚴(yán)峻的環(huán)境問題現(xiàn)狀并分析成因,最后談及鄉(xiāng)鎮(zhèn)企業(yè)環(huán)境問題與新農(nóng)村建設(shè)的關(guān)系。 第二章概述了當(dāng)前我國鄉(xiāng)鎮(zhèn)企業(yè)環(huán)境法制建設(shè)的現(xiàn)實。指出鄉(xiāng)鎮(zhèn)企業(yè)污染嚴(yán)重、令人堪憂的環(huán)境問題是在現(xiàn)行環(huán)境法律制度運行下出現(xiàn)的,并從環(huán)境立法、執(zhí)法、司法三個方面出發(fā)探究其中各自問題所在。 第三章概述了新農(nóng)村建設(shè)視野下鄉(xiāng)鎮(zhèn)企業(yè)環(huán)境法制的建設(shè)和完善路徑。在前文分析的基礎(chǔ)上,從環(huán)境立法、環(huán)境執(zhí)法、環(huán)境司法幾大層面入手,為完善新農(nóng)村背景下農(nóng)村鄉(xiāng)鎮(zhèn)企業(yè)環(huán)境法制提出了綜合的的預(yù)防、治理、監(jiān)督措施,試圖構(gòu)建起鄉(xiāng)鎮(zhèn)企業(yè)環(huán)境保護(hù)的完整法律體系。 結(jié)論統(tǒng)攬全篇、指出不足。
[Abstract]:After the fifth Plenary Session of the 16th CPC Central Committee, the construction of new socialist countryside in China fully sounded the clarion call, get rid of the plight of "three rural", new home reconstruction is the new period with the target of China's rural reform and development direction. The construction of new countryside needs all-round transformation of rural society many not harmonious, sustainable development, create a new socialist countryside the pattern in the countryside. Many not harmonious, sustainable development of township enterprises, economic development and environmental protection is not harmonious, especially not sustainable development: with the development of township enterprises in 30 years to grow, a variety of environmental problems has become increasingly prominent.
Today in the rule of law, to the construction of the development of production, affluent life, civilization, clean and tidy village, democratic management of new socialist countryside, promote the harmonious development of man and nature, we must effectively solve the dilemma caused the development of rural industry, strengthen the rural ecological and environmental protection efforts, including construction of legislation, law enforcement, judicial the set of environmental legal system.
This article explains the problem of the construction of the environmental legal system of township enterprises under the view of the construction of the new countryside with the content of five parts.
The introduction introduces the background and significance of the research, the literature review and the main research content.
The first chapter of the environmental issue of township enterprise in China to comprehensively review. In this chapter, clarifies the concept of township enterprises, summarizes the development of township enterprises has made valiant record key expressions of environmental problems, the grim situation of township enterprises and analyzes the reasons, finally talked about relationship between township enterprises and the construction of new countryside.
The second chapter summarizes China's current environmental legal construction of township enterprise in reality. It is pointed out that the township enterprises with serious pollution, environmental problems worrying is seen in the operation of the existing environmental legal system, and from the environmental legislation, law enforcement, judicial three aspects of starting to explore the respective problems.
The third chapter outlines the construction of township enterprise's environmental legal system under the background of new rural construction and perfect path. On the basis of the above analysis, from the environmental legislation, environmental law enforcement, with the major aspects of environmental justice, to improve the rural areas under the background of new rural township enterprises environmental legal system and puts forward the prevention, comprehensive management, supervision measures, trying to complete the construction of legal system of environmental protection of township enterprises.
Conclusion the whole thesis, pointed out the shortcomings.
