【摘要】：科學(xué)立法和民主立法是現(xiàn)代立法的兩大原則,也是保證立法質(zhì)量和法律獲得社會尊重的重要前提。歐盟立法機(jī)構(gòu)制定法律的過程較好地貫徹了這兩個原則。本文首先論述了歐盟保證科學(xué)立法的機(jī)制和具體措施,然后闡述了歐盟確保民主立法的機(jī)制和措施,其中,文章分別從社會學(xué)的角度探究和論證了這些機(jī)制和措施所產(chǎn)生的功效。在此基礎(chǔ)上,作者得出結(jié)論:歐盟已經(jīng)建立了較完備的保證科學(xué)立法和民主立法的機(jī)制和措施,這也是歐盟法不僅得到歐盟各機(jī)構(gòu)的尊重,而且得到歐盟各成員國遵守的重要原因。
[Abstract]:Scientific legislation and democratic legislation are the two main principles of modern legislation. It is also an important premise to ensure the quality of legislation and the respect of law. The process of making laws in EU legislative organs has carried out these two principles well. This paper first discusses the mechanism and concrete measures of EU to ensure scientific legislation. Then it expounds the mechanisms and measures to ensure democratic legislation in the EU. Among them, the article explores and demonstrates the effectiveness of these mechanisms and measures from a sociological perspective. The author concludes that the EU has established more complete mechanisms and measures to guarantee scientific and democratic legislation, which is an important reason for EU law to be respected not only by EU institutions, but also by EU member states.
