【摘要】：胡適是中國現(xiàn)代思想史上聚光燈式的人物。胡適對先秦法家的理解,既是其思想的一個(gè)組成部分,也是重新認(rèn)識中國法治與中國法家的一個(gè)切入點(diǎn)。胡適以西方學(xué)術(shù)的視野理解法家,以"講法治的書"與"法理學(xué)家"定性法家。胡適對法家之名的質(zhì)疑,對法家身份的認(rèn)定,對法家人物的辨析,對法家哲學(xué)的分述,對法治邏輯的梳理,對"韓非學(xué)"的概括與歸納,都具有思想史意義。胡適關(guān)于法家的著述主要集中在1917年前后。在一百年后的今日回望胡適描繪的法家思想肖像,不僅有助于接續(xù)先哲學(xué)思,而且可以為法家學(xué)說與法治理論的再研究確立一個(gè)不容忽視的思想?yún)⒄铡?br/>[Abstract]:Hu Shi is a spotlight figure in the history of modern Chinese thought. Hu Shi's understanding of the Legalists in the Pre-Qin Dynasty is an integral part of his thoughts. It is also a starting point to reunderstand the rule of law in China and the Chinese legalists. Hu Shi understands legalists from the perspective of western academic studies, characterizes legalists with "books on rule of law" and "jurists." Hu Shi questions the name of legalists and recognizes the identity of legalists. The discrimination and analysis of the Legalists, the division of the philosophy of the Legalists, the carding of the logic of the rule of law, the generalization and induction of the study of Han Fei, Hu Shi's writings on Legalists mainly focused on around 1917. A hundred years later, looking back at the portrait of Legalism depicted by Hu Shi is not only helpful to the continuation of philosophical thinking. Moreover, it can establish an important ideological reference for the further study of Legalist theory and rule of law theory.
