【摘要】： 自改革開放以來,三十余年的中國法治建設(shè)取得了許多成就。社會主義立法工作有條不紊的進行,社會主義司法體系初步確立,人們的權(quán)利意識逐漸提高,平等觀念不斷發(fā)展。然而中國社會在社會主義法治建設(shè)的過程中也出現(xiàn)了一些道德弱化、價值觀缺失現(xiàn)象,利己主義、唯利主義、享樂主義思想逐漸發(fā)展。為什么法治建設(shè)漸顯成效的時候,社會的道德風(fēng)氣和價值觀念卻和中國傳統(tǒng)價值觀要求出現(xiàn)了一定程度的背離呢?西方法律模式的建立是否會促使整個社會的道德水平和價值觀念得到升華呢? 本文從法律與社會的視角分析這些問題。通過對中國法治建設(shè)和中國傳統(tǒng)社會控制之間的關(guān)系、中國傳統(tǒng)社會控制和中國傳統(tǒng)價值觀念之間的關(guān)系、中國傳統(tǒng)價值觀念對中國傳統(tǒng)社會控制的反作用的分析,提出法治建設(shè)弱化了傳統(tǒng)社會控制進而弱化了傳統(tǒng)價值觀念,以及西方法治精神直接與中國傳統(tǒng)價值觀念存在一定程度的沖突問題。來回答為什么中國法治建設(shè)過程中會出現(xiàn)道德弱化、價值觀缺失現(xiàn)象。分析法治固有缺陷,引發(fā)人們進一步思考。站在一個不忍和中國幾千年文化歷史想斷絕,并認為中國傳統(tǒng)文化中有許多優(yōu)秀成分超越了西方某些思想的立場,站在一個認為有可能建立一種超越單純西方法律模式的更優(yōu)越制度的立場,引發(fā)人們重新思考什么是現(xiàn)代中國社會應(yīng)有的價值觀,重新思考我國法治建設(shè)的方向和路徑。
[Abstract]:Since the reform and opening up, China has made many achievements in the construction of the rule of law for more than 30 years. The socialist legislation has been carried out methodically, the socialist judicial system has been preliminarily established, and people's awareness of rights has been gradually raised. The concept of equality continues to develop. However, in the process of building the socialist rule of law in China, there have also been some weakening of morality, lack of values, egoism and profitarianism. The thought of hedonism is developing gradually. Why is it that when the construction of rule of law becomes more and more effective, the social morality and values deviate to a certain extent from the requirements of Chinese traditional values? Will the establishment of the western legal model promote the moral level and values of the whole society to be sublimated? This paper analyzes these problems from the perspective of law and society. Through the relationship between the construction of Chinese rule of law and the control of Chinese traditional society, the relationship between Chinese traditional social control and Chinese traditional values is discussed. An analysis of the reaction of Chinese traditional values to the control of Chinese traditional society, it is pointed out that the construction of the rule of law weakens the traditional social control and thus weakens the traditional values. And the conflict between the spirit of the rule of law in the west and the traditional values of China to a certain extent, to answer why the moral weakening and the lack of the values in the process of the construction of the rule of law in China, and to analyze the inherent defects of the rule of law. Provoking people to think further. Standing on a stand that they cannot afford to cut off China's cultural history for thousands of years, and that there are many excellent elements in Chinese traditional culture that transcend certain Western ideas, Standing in a position that it is possible to establish a more superior system beyond the pure western legal model, people should reconsider what the values should be in the modern Chinese society and the direction and path of the construction of the rule of law in our country.
