【摘要】： 立法與民主制度相結(jié)合能更好地保障立法理想的實(shí)現(xiàn),本文正是出于此目的而意欲構(gòu)建我國(guó)人大立法的民主機(jī)制。本文主要通過發(fā)現(xiàn)我國(guó)目前相關(guān)立法民主制度存在的問題,在介紹國(guó)外將立法與民制度相結(jié)合的實(shí)踐經(jīng)驗(yàn)的基礎(chǔ)上,針對(duì)具體問題,借鑒國(guó)外經(jīng)驗(yàn),構(gòu)建適合我國(guó)國(guó)情的人大立法民主機(jī)制,以確保立法的公平正義理想的實(shí)現(xiàn)。本文在構(gòu)建人大立法民主機(jī)制時(shí)對(duì)于公眾立法參與制度進(jìn)行重點(diǎn)研究,因?yàn)楣娏⒎▍⑴c制度是立法民主的最好體現(xiàn)。
[Abstract]:The combination of legislation and democratic system can better guarantee the realization of legislative ideal. For this purpose, this paper intends to construct the democratic mechanism of the legislation of the people's Congress of our country. On the basis of introducing the practical experience of combining the legislation with the people's system in foreign countries, aiming at the specific problems and drawing lessons from the foreign experience, the legislative democratic mechanism of the people's Congress which is suitable for the national conditions of our country is constructed. In order to ensure the realization of the ideal of fairness and justice in legislation, this paper focuses on the public legislative participation system, which is the best embodiment of legislative democracy.
