【摘要】：應(yīng)急法治建設(shè)是社會(huì)主義法治建設(shè)的重要組成部分,它是包括法治意識(shí)培養(yǎng)、應(yīng)急法律制度建設(shè)、應(yīng)急運(yùn)行機(jī)制建設(shè)等多個(gè)方面和突發(fā)事件處置、突發(fā)事件善后等多個(gè)階段的綜合體系。本文主要運(yùn)用跨學(xué)科研究法、文獻(xiàn)研究法、系統(tǒng)分析法等方法,理論聯(lián)系實(shí)際,分四個(gè)步驟詳細(xì)闡述了從社會(huì)心理看應(yīng)急法治建設(shè)的實(shí)現(xiàn)途徑的問題。 首先,以群體心理和群體性事件這兩個(gè)分別屬于社會(huì)心理和應(yīng)急法治的典型概念為切入點(diǎn),分析了群體心理和群體性事件的內(nèi)在必然聯(lián)系及其相關(guān)的規(guī)律,將社會(huì)心理規(guī)律和應(yīng)急法治建設(shè)自然的聯(lián)系起來。 其次,從法治意識(shí)培養(yǎng)、應(yīng)急法制建設(shè)、應(yīng)急機(jī)制建設(shè)等各個(gè)方面和突發(fā)事件處置、突發(fā)事件善后等各個(gè)階段介紹社會(huì)心理規(guī)律在其中的作用機(jī)理,詳細(xì)闡述了與應(yīng)急法治建設(shè)各個(gè)方面、各個(gè)階段有密切聯(lián)系的主要社會(huì)心理規(guī)律及這些心理規(guī)律在其中的作用機(jī)理,明晰了社會(huì)心理規(guī)律滲透和作用于應(yīng)急法治建設(shè)過程始終的事實(shí)。 再次,分別從應(yīng)急法治的應(yīng)然與應(yīng)急法治的實(shí)然的哲學(xué)角度和我國應(yīng)急法治建設(shè)的具體現(xiàn)實(shí)兩個(gè)方面詳細(xì)分析和介紹了我國的應(yīng)急法治的全面情況。 最后,從進(jìn)一步推動(dòng)應(yīng)急法治建設(shè)科學(xué)化、提升應(yīng)急法治建設(shè)理論化、加強(qiáng)應(yīng)急法治建設(shè)系統(tǒng)化、注重應(yīng)急法治建設(shè)實(shí)效性四個(gè)方面需要的角度詳細(xì)論證了社會(huì)心理與應(yīng)急法治建設(shè)結(jié)合的必要性;從目標(biāo)的一致性、內(nèi)容的共生性、方法的相容性、效果的互促性的角度詳細(xì)論證了社會(huì)心理與應(yīng)急法治建設(shè)結(jié)合的可行性。在此基礎(chǔ)上,從社會(huì)心理角度提出了重視社會(huì)化過程,培養(yǎng)法治意識(shí);了解真正動(dòng)機(jī),做好預(yù)防和應(yīng)急準(zhǔn)備等具體途徑,以期對進(jìn)一步加強(qiáng)應(yīng)急法治建設(shè)提供一些有益的思路和建議。
[Abstract]:The construction of emergency rule of law is an important part of the construction of socialist rule of law. It includes the cultivation of awareness of the rule of law, the construction of the emergency legal system, the construction of the emergency operating mechanism, and the handling of emergencies. This paper mainly uses the methods of interdisciplinary research, literature research, system analysis, and so on, to combine theory with practice. This paper expounds in detail the ways to realize the construction of emergency rule of law from the view of social psychology in four steps. First of all, based on the two typical concepts of group psychology and group events, which belong to social psychology and emergency rule of law respectively, this paper analyzes the inherent inevitable relationship and related laws of group psychology and group events. Will the social psychological law and emergency rule of law construction natural link. Secondly, it introduces the mechanism of social psychological law from the following aspects: training consciousness of rule of law, construction of emergency legal system, construction of emergency mechanism and so on. The main social and psychological laws which are closely related to the construction of emergency rule of law and the mechanism of these psychological laws are described in detail. It clarifies the fact that the law of social psychology permeates and acts on the construction of emergency rule of law. Thirdly, this paper analyzes and introduces the overall situation of emergency rule of law in detail from two aspects: the emergency rule of law and the realistic philosophy of emergency rule of law and the concrete reality of the construction of emergency rule of law in China. Finally, from the further promotion of the construction of emergency rule of law scientific, improve the construction of emergency rule of law theorization, strengthen the construction of emergency rule of law systematization, The necessity of combining social psychology with emergency rule of law construction is demonstrated in detail from four aspects: consistency of objective, symbiosis of content, compatibility of methods. From the angle of mutual promotion of effect, the feasibility of combining social psychology with emergency rule of law is demonstrated in detail. On this basis, the author puts forward from the angle of social psychology to attach importance to the socialization process, to cultivate the consciousness of rule of law, and to understand the real motive. To provide some useful ideas and suggestions for further strengthening the construction of emergency rule by law.
