【摘要】：隨著經(jīng)濟(jì)、科技的迅速發(fā)展,社會(huì)環(huán)境發(fā)生了巨大變化,我國(guó)青少年犯罪形勢(shì)愈發(fā)嚴(yán)峻,并呈現(xiàn)出了很多新特點(diǎn)。但我國(guó)青少年犯罪應(yīng)對(duì)措施卻存在著諸多方面的局限,應(yīng)對(duì)措施明顯落后,更新完善速度跟不上青少年犯罪情況的變化。值得注意的是信息社會(huì)的到來(lái),使青少年的犯罪原因發(fā)生著變化,互聯(lián)網(wǎng)的普及使青少年的生活方式有了巨大的轉(zhuǎn)變。提出利用互聯(lián)網(wǎng)建設(shè)青少年法制系統(tǒng)工程,不僅有利于青少年的教育、引導(dǎo)與保護(hù)而且有利于幫助以及矯治違法犯罪的青少年,是青少年工作方面的有益嘗試。 青少年法制系統(tǒng)工程以系統(tǒng)法學(xué)、結(jié)構(gòu)—功能主義以及復(fù)雜性理論為方法論基礎(chǔ),提出建立以保護(hù)為目標(biāo)的青少年法制系統(tǒng)工程。法制系統(tǒng)工程的運(yùn)作始終以其確立的目標(biāo)為導(dǎo)向,通過(guò)不斷的正負(fù)反饋調(diào)節(jié)來(lái)實(shí)現(xiàn)工程效果與目標(biāo)的逐漸一致。 青少年法制系統(tǒng)工程的系統(tǒng)模型是運(yùn)用演繹推理而得出的。文章以“通過(guò)法律的控制模型”為基礎(chǔ),說(shuō)明了青少年法制系統(tǒng)工程的運(yùn)作機(jī)制。而后運(yùn)用自組織和他組織理論,說(shuō)明了青少年法制系統(tǒng)工程業(yè)已形成的子系統(tǒng),即青少年立法、司法、執(zhí)法子系統(tǒng)和尚待重點(diǎn)建設(shè)的子系統(tǒng),即青少年法制信息子系統(tǒng)和青少年社會(huì)服務(wù)子系統(tǒng)。這兩個(gè)尚待建設(shè)的子系統(tǒng)能夠起到激活全局的作用,是青少年法制系統(tǒng)工程的建設(shè)重點(diǎn)。 青少年法制系統(tǒng)工程的各個(gè)子系統(tǒng)都有著相應(yīng)的作用,以保障系統(tǒng)的作用發(fā)揮。其中決策控制機(jī)構(gòu)(青少年教育、立法、司法決策系統(tǒng))主要是根據(jù)系統(tǒng)目標(biāo)劃定青少年的“行為可能性空間”,其產(chǎn)生的決策通常會(huì)在執(zhí)行效應(yīng)機(jī)構(gòu)(青少年立法、司法、執(zhí)法機(jī)構(gòu))中以法律法規(guī)及政策措施的形式出現(xiàn)。信息接受機(jī)構(gòu)(青少年法制信息系統(tǒng))將接收到的各種信息進(jìn)行分析,從而指導(dǎo)實(shí)踐,同時(shí)也將信息輸送到?jīng)Q策控制機(jī)構(gòu)進(jìn)行反饋。青少年社會(huì)服務(wù)系統(tǒng)主要提供專門的青少年社會(huì)工作以及負(fù)責(zé)一部分法制信息的記錄工作,它的建立完善,有利于青少年權(quán)利保護(hù),有利于整個(gè)青少年法制系統(tǒng)工程的運(yùn)作。 可以看出,青少年法制系統(tǒng)工程的建設(shè)并非一日之功,所以最終,本文提出了我們應(yīng)當(dāng)集中力量重構(gòu)青少年工作者的隊(duì)伍和加強(qiáng)青少年工作的信息化建設(shè),以此來(lái)開啟青少年法制系統(tǒng)工程的運(yùn)作。
[Abstract]:With the rapid development of economy, science and technology, great changes have taken place in the social environment. The situation of juvenile delinquency in our country has become more and more serious, and has shown many new characteristics. However, there are many limitations in the countermeasures of juvenile delinquency in our country. The response measures are obviously backward, and the pace of updating and perfecting cannot keep up with the changes in juvenile delinquency. It is worth noting that the arrival of the information society has changed the causes of juvenile delinquency. The popularity of the Internet has made a huge change in the way of life of young people. It is proposed that the use of the Internet for the construction of a legal system for young people is not only conducive to the education of young people, Guiding and protecting and helping and correcting juvenile delinquency is a useful attempt in juvenile work. The system engineering of juvenile legal system is based on systematic law, structure-functionalism and complexity theory. This paper puts forward the establishment of juvenile legal system engineering with the goal of protection. The operation of legal system engineering is always guided by its established goal, and the engineering effect is gradually consistent with the goal through continuous positive and negative feedback regulation. The system model of juvenile legal system engineering is derived from deductive reasoning. Based on the "control model through law", this paper explains the operational mechanism of the system engineering of juvenile legal system, and then applies the theory of self-organization and other organization. It explains the subsystems that have been formed in the juvenile legal system project, that is, the juvenile legislation, the judiciary, the law enforcement subsystem and the subsystem that needs to be built. That is, the juvenile legal information subsystem and the juvenile social service subsystem, which can activate the whole situation, are the key points in the construction of the juvenile legal system project. Every subsystem of the legal system engineering of teenagers plays a corresponding role in order to ensure the function of the system. Among them, the decision-making control institutions (youth education, legislation, Judicial Decision-Making system (JDSS) is mainly defined as the "behavioral possibility space" of adolescents according to the system objectives, and the decisions they produce usually take place in the executive effector agencies (juvenile legislation, administration of justice, etc.). In law enforcement agencies, in the form of laws, regulations and policy measures. The information receiving agency (the Youth legal system Information system) will analyse the various information received to guide practice, At the same time, the information is also sent to the decision-making control organization for feedback. The youth social service system mainly provides specialized social work for young people and is responsible for recording part of the legal information. It has been established and perfected. It is beneficial to the protection of the rights of young people and the operation of the whole legal system of teenagers. It can be seen that the construction of the juvenile legal system project is not a day's success, so finally, this paper proposes that we should concentrate our efforts on reconstructing the contingent of youth workers and strengthening the information construction of youth work. In order to start the youth legal system project operation.
