法制教育中的法律權(quán)威觀研究

【摘要】:法制教育是思想政治教育的一個(gè)重要內(nèi)容,它屬于思想政治教育中的政治教育,具有階級(jí)性、強(qiáng)制性等特點(diǎn)。法制教育的目的在于培養(yǎng)人們的政治素質(zhì),法制教育是建設(shè)社會(huì)主義法治國(guó)家的重要基礎(chǔ)。然而僅僅從增長(zhǎng)公眾的法律知識(shí)這一層次上開(kāi)展法制教育是遠(yuǎn)遠(yuǎn)不夠的,還要將其上升為公民對(duì)法律的一種內(nèi)在的尊重,即法律是有權(quán)威的,法制教育應(yīng)重在培養(yǎng)人們的法制權(quán)威觀。 然而法律權(quán)威觀樹(shù)立的過(guò)程并不是一帆風(fēng)順的,中國(guó)傳統(tǒng)法律文化中的權(quán)力本位思想和以“禮”為核心的等級(jí)觀念都嚴(yán)重阻礙了法律權(quán)威觀的樹(shù)立,中國(guó)社會(huì)不具備法律權(quán)威觀形成的文化基礎(chǔ)。法制教育方法單一,法制教育與實(shí)踐相脫節(jié),法制教育的環(huán)境不協(xié)調(diào)等,是法律權(quán)威觀難以實(shí)現(xiàn)的第二個(gè)原因。法律實(shí)施的過(guò)程中存在的一些問(wèn)題是法律權(quán)威觀難以樹(shù)立的第三個(gè)原因。 針對(duì)以上問(wèn)題,應(yīng)從以下幾方面出發(fā)才能逐步樹(shù)立公眾的法律權(quán)威觀,第一,發(fā)揮傳統(tǒng)法律文化中的積極因素,借鑒西方法治建設(shè)的經(jīng)驗(yàn),建設(shè)中國(guó)特色社會(huì)主義法律文化。第二,要改進(jìn)法制教育方式,增強(qiáng)教育效果。第三,要通過(guò)提高立法質(zhì)量,提升執(zhí)法人員素質(zhì),完善監(jiān)督機(jī)制來(lái)完善法律的實(shí)施過(guò)程。
[Abstract]:Legal education is an important content of ideological and political education, it belongs to the political education in ideological and political education, it has the characteristics of class nature and compulsion. The purpose of legal education is to cultivate people's political quality. Legal education is an important foundation for building a socialist country ruled by law. However, it is far from enough to develop legal education from the level of increasing the legal knowledge of the public. That is, law is authoritative, and legal education should focus on cultivating people's view of legal authority. However, the process of establishing the view of legal authority is not smooth. The idea of power standard in Chinese traditional legal culture and the hierarchical concept of "propriety" as the core have seriously hindered the establishment of the view of legal authority. Chinese society does not have the cultural basis for the concept of legal authority, the single method of legal education, the disconnection between legal education and practice, the disharmony of the environment of legal education, etc. It is the second reason that the view of legal authority is difficult to realize, and some problems in the process of implementing law are the third reason that it is difficult to establish the view of legal authority. In view of the above problems, we should set up the public's view of legal authority from the following aspects: first, give full play to the positive factors in the traditional legal culture and learn from the experience of the construction of the rule of law in the West. Second, we should improve the way of legal education and enhance the effect of education. Third, we should improve the quality of legislation, improve the quality of law enforcement personnel and perfect the supervision mechanism to perfect the process of law enforcement.
