【摘要】：文章剖析法律的善惡標準難統(tǒng)一、守法過程自利傾向明顯、權力主體守法現(xiàn)象缺失、公民守法意識較為薄弱等方面就守法養(yǎng)成的驅(qū)動障礙,分析驅(qū)動障礙的原因,即傳統(tǒng)倫理與守法精神的沖突、社會封建專制集權對意識的影響、市場經(jīng)濟體制轉(zhuǎn)軌不夠健全、社會民主法治建設有待完善。重點研究在消極的不違法、自覺不自愿的守法、積極自覺且自愿的守法三種公民守法養(yǎng)成的目標趨向上的激勵措施,即完善法律體系建設,統(tǒng)一法律善惡標準;挖掘傳統(tǒng)文化資源,消除守法功利心理;健全剛性約束機制,完善守法保證機制;強化守法主體意識,提升守法道德境界。
[Abstract]:This paper analyzes the driving obstacles of law-abiding cultivation in the following aspects, such as the difficulty of unifying the standards of good and evil of law, the obvious self-interest tendency of law-abiding process, the absence of law-abiding phenomenon of power subject, the weak consciousness of citizen law-abiding, and so on, and analyzes the causes of driving obstacles. That is, the conflict between traditional ethics and law-abiding spirit, the influence of social feudal autocracy on consciousness, the imperfect transition of market economy system and the construction of social democracy and the rule of law. Positive, conscious and voluntary law-abiding three kinds of citizen law-abiding goal tend to encourage measures, that is, perfect the legal system construction, unify the law good and evil standard, excavate the traditional cultural resources, eliminate the law-abiding utilitarian psychology, perfect the rigid restraint mechanism, Perfect the mechanism of law-abiding guarantee, strengthen the consciousness of law-abiding subject and raise the realm of law-abiding morality.
