【摘要】："法治經(jīng)濟(jì)"是對(duì)市場經(jīng)濟(jì)在法律層面的本質(zhì)特征的概括。法治經(jīng)濟(jì)的構(gòu)成包括兩個(gè)方面:一是為解決基于普遍市場規(guī)律的共通性問題而建立的法治框架;二是為解決各國市場經(jīng)濟(jì)發(fā)展的獨(dú)特性問題而確立的法治技術(shù)。中國自改革開放以來,解決"標(biāo)準(zhǔn)市場"的共通性問題所需要的基本法治框架逐步形成,統(tǒng)貫各個(gè)必備要素的支撐性觀念也比較明顯地體現(xiàn)在不同時(shí)期國家和執(zhí)政黨的正式文件中。中國市場經(jīng)濟(jì)發(fā)展最重要的獨(dú)特性問題,即公有制基礎(chǔ)上如何實(shí)行市場經(jīng)濟(jì)的問題,隨著國家所有權(quán)行使代表制、企業(yè)法人財(cái)產(chǎn)權(quán)制度的確立,以及國家從"所有者"變?yōu)?出資人"的角色轉(zhuǎn)變,在法治技術(shù)層面基本得以解決。經(jīng)過近四十年的發(fā)展,滿足市場經(jīng)濟(jì)最低需求的法治基礎(chǔ)在中國已大體形成,中國社會(huì)主義市場經(jīng)濟(jì)建設(shè)已開始進(jìn)入法治經(jīng)濟(jì)階段。
[Abstract]:"economy by law" is a summary of the essential characteristics of market economy on the legal level. The constitution of the economy of rule of law includes two aspects: one is the framework of rule of law to solve the problem of commonality based on the law of universal market; Second, the rule of law technology established to solve the unique problems in the development of the market economy in various countries. Since China's reform and opening up, the basic framework of the rule of law needed to solve the common problems of "standard market" has been gradually formed. The concept of supporting the essential elements of unification is also clearly reflected in the official documents of the state and the ruling party in different periods. The most important unique issue in the development of China's market economy is how to implement the market economy on the basis of public ownership. With the representative system of state ownership, the establishment of corporate property right system, and the change of the role of the state from "owner" to "investor", it has basically been solved in the technical aspect of rule of law. The foundation of the rule of law to meet the minimum needs of the market economy has been basically formed in China, and the construction of the socialist market economy in China has begun to enter the stage of economic ruled by law.
