【摘要】：《行政許可法》的頒布實施,對于我國民主與法制建設(shè)產(chǎn)生重大而深遠的影響,建立法制統(tǒng)一、公正廉潔、便民高效的政府是我國現(xiàn)代民主與法制建設(shè)的目標;行政許可法中的默示制度行政許可法中引入默示制度是對傳統(tǒng)行政法明示許可的一個挑戰(zhàn),因此在適用行政許可默示制度時,應(yīng)嚴格而準確的判定默示制度是否可以使用,使默示制度在行政法中發(fā)揮真正意義上的利益平衡、提高行政效率、促進行政法發(fā)展的作用。第一部分從民法中的默示概念入手,論述了默示與明示、默示與沉默的區(qū)別,對默示意思推定進行了闡述,引出行政許可默示制度,并對行政許可默示制度的性質(zhì)、概念、分類進行了詳細的分析,目的在于使人們對行政許可默示制度有較為系統(tǒng)化的認識,并對行政法中的默示制度與民法中的默示制度的區(qū)別進行了分析,突出行政許可默示制度的特點,使人們更清楚的認識和理解行政許可默示制度。第二部分分析了國內(nèi)外的立法實踐,主要講了葡萄牙、意大利、臺灣地區(qū)和澳門地區(qū)的立法經(jīng)驗,并結(jié)合我國的最新立法實踐“超時默許”制度進行分析,目的在于為我國行政許可默示制度的完善提供依據(jù)。第三部分根據(jù)我國行政許可默示制度的實踐,分析出我國實行行政許可默示制度存在的不足和問題。第四部分根據(jù)第三部分的不足提出立法建議,完善我國行政許可默示制度的不足。
