新鄉(xiāng)土社會中禮治和法治的沖突與整合

【摘要】: 本文的研究思路立足于社會轉(zhuǎn)型期的中國新鄉(xiāng)土社會,之所以稱其為新鄉(xiāng)土社會,是與費孝通先生的《鄉(xiāng)土中國》中的中國傳統(tǒng)鄉(xiāng)土社會相對而言的。新鄉(xiāng)土社會呈現(xiàn)出鄉(xiāng)土本色逐漸消退、國家權(quán)力作用方式相對柔和、多元權(quán)威出現(xiàn)等社會轉(zhuǎn)型期的顯著特征,且在這種新的境況下,維護鄉(xiāng)土社會秩序的傳統(tǒng)手段——禮治出現(xiàn)了逐漸弱化的態(tài)勢,而近代以來向西方學習的法治也在鄉(xiāng)土社會遭遇到諸多現(xiàn)實困境。兩者在全面大量的接觸中,產(chǎn)生了激烈的沖突和矛盾,同時也存在相互融合的可能性和必要性。本文的創(chuàng)新之處就在于探索解決禮治和法治的矛盾沖突實現(xiàn)二者協(xié)調(diào)發(fā)展的有效途徑。 文章共分為三個部分。第一部分主要分析了我國傳統(tǒng)鄉(xiāng)土社會的基本特征,包括鄉(xiāng)土本色、血緣地緣和差序格局,以及傳統(tǒng)維護鄉(xiāng)土社會秩序的禮治的具體內(nèi)容。隨著中國社會的轉(zhuǎn)型和市場經(jīng)濟的發(fā)展,傳統(tǒng)鄉(xiāng)土社會逐步過渡到新鄉(xiāng)土社會并出現(xiàn)了一系列新的特征,禮治和法治并存成為維護其社會秩序的的手段,具體表現(xiàn)為禮治的逐漸弱化和法治的運行困境。第二部分論述禮治和法治的相互關系,兩者之間既有共同點也有不同點,詳細介紹禮治和法治的顯性優(yōu)勢及其局限性,以及兩者之間的沖突和矛盾,表現(xiàn)為法治對禮治的取代和破壞和禮治對法治的置換和違背。第三部分是本文的創(chuàng)新之處,在前面兩章論述分析的基礎上,提出解決禮治和法治沖突與對立的具體途徑,包括:在觀念上,尊重、善待禮治,加強法治教育。在立法上,法治要汲取鄉(xiāng)土社會的禮治資源完善我國的法治建設。在法的實施上,執(zhí)法方面要積極探索具有鄉(xiāng)村特色的執(zhí)法方法;司法方面要建立禮治與法治相互融入與援引的司法制度;守法方面要加強對農(nóng)民法治意識的培養(yǎng)和內(nèi)化等。同時還要努力探索禮治和法治的互動領域,實現(xiàn)對禮治和法治的整合。
[Abstract]:The research idea of this paper is based on the new local society of China in the period of social transformation, and it is called the new local society. It is relatively speaking with the Chinese traditional local society in Fei Xiaotong's "Native China". The new local society presents the native nature gradually fade, the state power function way is relatively soft. The emergence of pluralistic authority and other prominent features of the social transition period, and in this new situation, the maintenance of the traditional means of rural social order-rule of etiquette has gradually weakened. In modern times, the rule of law from the West has also encountered many practical difficulties in the local society. In a large number of comprehensive contacts, there have been fierce conflicts and contradictions between the two. At the same time, there is the possibility and necessity of mutual fusion. The innovation of this paper is to explore the effective way to solve the contradiction and conflict between the rule of etiquette and the rule of law to realize the harmonious development of the two. The article is divided into three parts. The first part mainly analyzes the basic characteristics of the traditional local society in China, including the native color, consanguinity, geography and different order pattern. Along with the transformation of Chinese society and the development of market economy, the traditional local society gradually transitioned to the new native society and appeared a series of new characteristics. The coexistence of the rule of etiquette and the rule of law has become the means to maintain its social order, which is embodied in the gradual weakening of the rule of etiquette and the difficulty of the operation of the rule of law. The second part discusses the relationship between the rule of etiquette and the rule of law. There are not only common points but also differences between them. This paper introduces in detail the dominant advantages and limitations of rule of etiquette and rule of law, as well as the conflicts and contradictions between them. The third part is the innovation of this paper, on the basis of the analysis of the preceding two chapters. The specific ways to solve the conflict and opposition between the rule of etiquette and the rule of law are put forward, including: in concept, respect, treat well with the rule of etiquette, strengthen the education of rule by law, and legislate. The rule of law should draw on the resources of the local society to perfect the construction of the rule of law in our country. In the implementation of the law, the law enforcement should actively explore the law enforcement methods with rural characteristics; In the judicial aspect, we should establish a judicial system in which the rule of etiquette and the rule of law are mutually integrated and invoked; In the aspect of abiding by the law, we should strengthen the cultivation and internalization of peasants' consciousness of ruling by law, and at the same time, try to explore the interactive field between rule of etiquette and rule by law, and realize the integration of rule of etiquette and rule by law.
