【摘要】：運(yùn)用法學(xué)的構(gòu)成要件理論,從法治的實(shí)體價(jià)值和形式價(jià)值兩方面探討法治反腐的構(gòu)成要件問題。法治反腐的實(shí)體構(gòu)成要件主要包括三個(gè)方面:權(quán)力制衡的法治國家;公民合法權(quán)利的保障;司法地位的公正獨(dú)立。法治反腐同時(shí)具有以下形式構(gòu)成要件:法律至上原則;普遍性原則;程序正義原則。通過對法治反腐的實(shí)體要件和形式要件進(jìn)行理論分析,闡釋法治反腐的應(yīng)然狀態(tài)。
[Abstract]:Using the theory of constitutive elements of law. From the substantive value and formal value of the rule of law, this paper discusses the constitutive elements of anti-corruption under the rule of law. The substantive elements of anti-corruption under the rule of law mainly include three aspects: a country ruled by law with checks and balances of power; The guarantee of citizens' legal rights; Judicial status of impartiality and independence. The rule of law anti-corruption also has the following form elements: the principle of the supremacy of law; The principle of universality; The principle of procedural justice. Through the theoretical analysis of the substantive and formal elements of anti-corruption under the rule of law, this paper expounds the necessary state of anti-corruption under the rule of law.
